Minutes of the second regular meeting of the 2003/2004 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Avenue, Glenboro, Manitoba on Tuesday, December 9, 2003 at 9:00 a.m. Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, in the chair, called the meeting to order at 9:01 a.m. During the meeting, at the time indicated, Council held the noted public hearing and meet with the following delegations. Edwin A. #6944 J. S. Hamilton – L. J. Berry RESOLVED that the minutes of the last regular meeting of Council held on November 12, 2003 be taken as read and approved, all statutory requirements having been fulfilled. "carried"
#6945 W. R. Cullen – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2003 accounts from cheque #1561 to and including cheque #1623, as submitted to Council by the Chief Administrative Officer. "carried"
#6946 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1775 (Re: 2003 Tax and Debt Cancellations), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. "carried"
#6947 L. E. Coates – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1776 (Re: Appointments of 2004 Municipal Fireguardians), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. "carried"
#6948 J. S. Hamilton – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1777 (Re: Appointments of 2004 Poundkeepers, Appraisers and Cemetery Sextons), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1778 (Re: Sale of N ½ of Lots 9 & 10; Block 1; Plan 388 MLTO to Rosalind Kelly), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. #6950 L. E. Coates - J. S. Hamilton RESOLVED that the Council of the Rural Municipality of South Cypress give first reading to By-law #1779, (Re: Borrowing/Overdraft Authorization @ Westoba Credit Union Ltd., Glenboro Branch). "carried"
#6951 L. E. Coates – J. S. Hamilton RESOLVED that the Council of the Rural Municipality of South Cypress give first reading to By-law #1780 (Re: Appointment of the 2004 Chief Administrative Officer). "carried"
#6952 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress appoint Edwin A. Berry as Municipal Equipment Operator and Foreman for the Year 2004, as per Terms/Conditions to be specified in his respective Year 2004 Employment Agreement. "carried"
#6953 L. E. Coates – W. J. Mooney WHEREAS Municipal Equipment Operator, H. Wayne Johnson’s 2003 Employment Agreement specifies a 2003 wage per hour and is set to expire on December 27, 2003; AND WHEREAS Mr. Johnson will officially retire on February 6, 2004; NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress confirm that Mr. Johnson’s rate of pay from December 28, 2003 to February 6, 2004 be increased by 2%. "carried"
#6954 L. E. Coates – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress appoint Allan Bartram as Permanent Full-Time Municipal Equipment Operator for the Year 2004, (Gravel Truck/Loader Operator in the summer season and Snowplough Operator in the winter), , effective December 28, 2003 as per Terms & Conditions to be specified in his Year 2004 Employment Agreement. "carried"
#6955 J. S. Hamilton – L. J. Berry RESOLVED that the Council or the Rural Municipality of South Cypress advertise for the invitation of applications for the Seasonal Employment Position of Municipal Grader Operator, commencing in the spring of 2004. "carried"
#6956 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress contract the services of Norbert’s Manufacturing of Glenboro, Manitoba to strip, sandblast, rock-guard, prime and paint the Municipality’s 2000 Decap Gravel trailer at a total cost of approximately $5,000.00, plus taxes and as per further details specified in their December 3, 2003 quotation. "carried"
#6957 L. E. Coates – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress enter into a right of way agreement with Snowmobilers of Manitoba Inc. and Tri-Lake Trail Busters for their "right of use" of certain Municipal Road Ditches and Road Allowances lying in the Municipality, which they propose to access/traverse during the 2003/2004 Winter Snowmobiling Season. "carried"
#6958 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress request the Minister of Manitoba Highways and Transportation to include within the Department’s short-range construction plans, the hard surfacing of the unpaved portion (approximately 16 kms) of Provincial Road #340 south of the Canadian Forces Base Shilo to Provincial Road #453 "carried"
At a Public Hearing held at 2:00 p.m., in regard to Conditional Use application #CU7—3-SC, representation made was by the applicant, Tom Keller and also by Carol Criddle and Garnet Shearer.
#6959 L. E. Coates – L. J. Berry UNDER THE PLANNING ACT CONDITIONAL USE ORDER NO. CU7-03-SC Whereas OAKVIEW PORK / KELLER AND SONS FARMING LTD. the owners of the property legally described as Pt. of the NE ¼ SEC. 31-8-16 WPM and located at approx. 7 miles Northwest of the Village of Treesbank in the R. M. of South Cypress applied to the Council of the R. M. of South Cypress for approval of a Conditional Use under Zoning By-Law No. 1485 Part IV, Section 6, Table IV-I, in order to: PROVIDE FOR THE ADDITION OF A QUARANTINE BARN (20’ X 58’ approx.) TO THE EXISTING LIVESTOCK BARN ON SITE IN THE "A80" AGRICULTURAL DISTRICT. THIS IS AN ADDITIONAL 33 LIVESTOCK WASTE UNITS (LWU) OR 14 ANIMAL UNITS (AU) APPROXIMATELY. and after careful consideration of the application and any representations made for or against it, the Council of the R. M. of South Cypress in a meeting duly assembled on the 9th day of December AD; 2003 APPROVED the said application. Approval is given subject to the following conditions: That the conditions outlined in Schedule "A" of Conditional Use Order CU3-00-SC as approved by Council on February 13, 2001, shall continue to apply. That Manitoba Conservation Order #W-03-10, regarding the repair of the concrete manure storage facility, be complied with prior to the operation of the said quarantine barn. Approval shall expire if not acted upon within 12 months of the date of making. "carried"

Mooney RESOLVED that the Plan of Subdivision of Land described as follows; Being Part of the South West ¼ of Section 27, Township 7, Range 15 W1, as shown on a drawing and being attached to an application for Subdivision file #14-4187-03-3995 and being submitted by Mr. Brent Cullen; BE HEREBY APPROVED by the Council of the Rural Municipality of South Cypress. Approval is given subject to the following conditions: That a Conditional Use Order be obtained to permit the non-farm dwelling site within the "A80" zone. That the sewage disposal system be brought into compliance with Manitoba Environmental Regulation 77/2003. That a Variation Order be obtained to permit the siting of the present mobile home, which has a minimum front yard setback of less than 125’. "carried"

Cullen WHEREAS in accordance with Section 163 of the Municipal Act, the Council of the Rural Municipality of South Cypress has made an Interim Operating Budget for all the expenditures of the Municipality for the period January 1, 2004 until the adoption of the annual estimates; NOW THEREFORE BE IT RESOLVED that the provisional estimates as set out in Schedule "A" be hereby approved by the Council of the Rural Municipality of South Cypress. RESOLVED that the Council of the Rural Municipality of South Cypress appoint Maureena McPhail as the Municipal Accounting Clerk for the Year 2004 as per Terms/Conditions to be specified in her respective Year 2004 Employment Agreement. "carried" #6963 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress apply to Manitoba Highways and Transportation for a year 2004 grant of up to $1,148.40 for improvements to a portion of P.R. #530, consisting of building up the road base with shale. "carried"
#6964 L. E. Coates – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize Reeve Earl E. Malyon and Councillor John S. Hamilton to attend a P.R.F.A./Agri-Food Canada and Manitoba Water Stewardship Public Meeting regarding the proposed upgrading to the Shellmouth Dam, which is to be held in Portage La Prairie on Monday, December 15, 2003. "carried"
#6965 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress do now adjourn @ 4:15 p.m., to convene again for our next regular meeting scheduled for Tuesday, January 13, 2004 at 9:00 a.m. "carried" |
