Minutes of the fourth regular meeting of the 2002/2003 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Avenue, Glenboro, Manitoba on Tuesday, February 11, 2003 at 9:00 a.m. Present at the Meeting: Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, W. Jack Mooney, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, in the chair, called the meeting to order at 9:10 a.m. During the meeting, at the time indicated, Council met with the following delegations. #6768 W. J. Mooney – W. R. Cullen RESOLVED that the minutes of the last regular meeting of Council held on Tuesday January 14, 2003 be taken as read and approved, all statutory requirements having been fulfilled. "carried"
#6769 J. S. Hamilton - L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress adopt the Municipality’s Financial Statement for Fiscal Year ending December 31, 2002, as presented by the Chief Administrative Officer, showing a Net Operating Surplus of $ 29,683.08. "carried"
#6770 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2003 accounts from cheque #1013 to and including cheque #1056, as submitted to Council by the Chief Administrative Officer. "carried"
#6771 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize the purchase of a new 2003 SCHULTE FLX10 FLEX ARM (offset mower hitch) from Farmers Premium Equipment of Deloraine, Manitoba. "carried"
#6772 W. J. Mooney – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress adopt the following policy forthwith; No Dirt, Sand or Gravel is to be removed from any Municipal Road allowance, whether developed or not, unless first authorized by the Council of the Rural Municipality of South Cypress. AND FURTHER BE IT RESOLVED that any such aggregate removed by the permittee shall be charged at the rate of .50 cents per cubic yard, subject to Section 292 of The Municipal Act. "carried"
#6773 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize Municipal Equipment Operators Edwin Berry, H. Wayne Johnson and Allan Bartram to attend the Manitoba Good Roads Association Workshop, and the A.M.M. Trade Show, which are both being held in Brandon, Manitoba on Monday, February 24, 2003. "carried"
#6774 J. S. Hamilton – W. R. Cullen RESOLVED that the year 2003 spring road restrictions, for designated municipal roads within the limits of the R. M. of South Cypress, will commence on or after March 15, 2003; (actual implementation date dependent on weather conditions) and shall remain in effect for a period of six to eight weeks. The following specified municipal road, lying within the Rural Municipality of South Cypress, which is classified as a "B Highway", shall be weight restricted, when so posted, to 65% of normal axle loads; 1 mile of Public road lying within Section 3; Township 7; Range 14 WPM, referred to as the I.P.L Road, and 3 miles of Public Road lying directly North of Sections 25 & 26; Township 7; Range 14 WPM and Directly North of Section 30; Township 7; Range 13 WPM. With the exception of the above noted roads, all other municipal roads, within the limits of the Rural Municipality of South Cypress will not be subject to spring weight restrictions. "carried"

Cullen RESOLVED that the Council of the Rural Municipality of South Cypress apply to Manitoba Highways and Transportation for a year 2003 grant of up to $ 1,148.40 for improvements to a portion of P.R. #530, consisting of building up the road base with shale. "carried" #6776 L. J. Berry – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress of South Cypress accept the year 2003 budget of Cypress Planning District requiring a year 2003 levy from the R. M. of South Cypress amounting to $ 9,240.00. "carried"
#6777 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize any member of Council and the C.A.O. to attend a one-day Seminar, on Municipal Weed Control Issues, being hosted by Manitoba Agriculture and the Manitoba Weed Supervisors Association, which is to be held in Holland, Manitoba on Wednesday, March 19, 2003. "carried"
#6778 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress grant $ 400.00 to the Glenboro Agricultural Society to aid in their staging of their annual fair, to be held on June 30 & July 1, 2003. "carried"
#6779 J. S. Hamilton – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize a $ 200.00 grant to the Glenboro-South Cypress Heritage Advisory Committee to aid in its operations during the year 2003. "carried"
#6780 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress endorse the January 6, 2003 application for the exchange of approximately 18 acres of land being part of LS 9 (North of the Assiniboine River) of the NE 3-8-14 WPM, currently owned by Mr. Brad Vertz with approximately 16 acres of land being part of LS 11 (South of the Assiniboine River) of The NW 3-8-14 WPM, currently owned by province of Manitoba, as fully detailed in Manitoba Lands Branch Sale No. 48737. "carried"

Mooney RESOLVED that the Council of the Rural Municipality of South Cypress authorize a grant of $ 100.00 to the Assiniboine Regional Health Authority in support for the purchase of an approximately 10,000 emergency response information kits, which are to be provided to all seniors (70 years and over) residing in the said RHA. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize a $ 500.00 grant to the Seniors Independent Services Board to aid in its operations during the year 2003. "carried"
#6783 L. J. Berry - J. S. Hamilton WHEREAS as provided for in Section 365(2) of the Municipal Act, a Council may in any year designate the immediately preceding year or any earlier year as the year for which properties the taxes in respect of which are in arrears for the year must be offered for sale by auction to recover the tax arrears and costs; NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress, designate Tax Year 2002 as the year for which properties the taxes in respect of which are in arrears (2001 Taxes) must be fully paid prior to commencement of the 2003 Municipal Tax Sale and failing payment of all 2001 tax arrears the respective property will be offered for sale by auction in order to recover the tax arrears and costs; AND FURTHER BE IT RESOLVED that the Rural Municipality of South Cypress conduct its 2003 Tax Sale at an appropriate time & date in the Fall, of the year 2003. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress hold a special meeting on Monday, March 17, 2003 at 12:00 p.m. to set and adopt the Municipality’s Budgeted Operating Expenditures for fiscal year 2003. AND FURTHER BE IT RESOLVED that in compliance with Section 162(2) of The Municipal Act, the Council of the Rural Municipality of South Cypress hold a Public Hearing on Tuesday, April 15, 2003 at 1:30 p.m. in the R. M. of South Cypress Council Chambers at Glenboro, Manitoba for the purpose of presenting its Financial Plan for fiscal year 2003 and subsequently giving any person who wishes, opportunity to make representation, ask questions or register an objection to the Financial Plan so presented.
