Minutes of the seventh regular meeting of the 2002/2003 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, May 13, 2003 at 8:00 a.m.
Present at the meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, W. Jack Mooney, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck.
Reeve Earl E. Malyon, in the chair, called the meeting to order at 8:02 a.m.
During the meeting, at the time indicated, Council conducted the noted Public Hearing and also met with the following delegations. #6823 W. J. Mooney – W. R. Cullen RESOLVED that the minutes of the last meeting of Council held on Tuesday April 15, 2003 be taken as read and approved, all statutory requirements having been fulfilled. "carried"
During the second and third reading of By-law #1773, Municipal Administrator Eric Plaetinck, summarized that the Municipality’s budget and associated tax levy by-law for fiscal year 2003 resulted in a Municipal levy of 14.85 mills, which will represent a "cost of living" increase of 2.9% in this year’s Municipal property taxes. #6824 L. J. Berry - J. S. Hamilton RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1773 (School and Municipal Tax Levy for fiscal year 2003) and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. "carried"
#6825 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2003 accounts from cheque #1159 to and including cheque #1217, as submitted to Council by the Chief Administrative Officer. "carried" #6826 W. R. Cullen – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress approve an arrangement with Canadian Forces Base Shilo concerning the retention of a Military gate located at the SE ¼ of Section 4-8-15 W1, the continued use of a Public Road located along the southern property line of the SE ¼ of Section 4-8-15 W1 and the physical closing of 1 mile of unimproved road allowance lying between Section 4 and Section 9; Township 8; Range 15 WPM, as further outlined in an April 15, 2003 letter from Base Commander, C. G. Simonds attached hereto and marked as Appendix "A". "carried"
At a public hearing held at 11:30 a.m., in regard to Variation application file #CU11-02-SC, no representation was made either for or against the said application. #6827 W.J. Mooney – L. J. Berry UNDER THE PLANNING ACT VARIATION ORDER BY THE R. M. OF SOUTH CYPRESS VARIATION ORDER NO: V4-03-SC WHEREAS Matthew Neale, son of the owner of the property legally described as Pt. Of the SW ¼ 4-7-15 WPM, R. M. of South Cypress and located at approximately eight miles west of Glenboro applied to the Council of the R. M. of South Cypress to vary the application of Part IV, Section 8, Zoning By-Law No. 1485 provided under Clause (A) of Subsection (3) of Section 57 of The Planning Act as it applies to the property, in order to vary the established requirements as follows: FROM: A minimum front yard setback of 125 feet. TO: A minimum front yard setback of 80 feet approx. FOR THE PURPOSE: Accommodating the location of a mobile home – residence. And after careful consideration of the application and any representations made for or against the variation sought by the applicant, Matthew Neale, the R. M. of South Cypress in meeting duly assembled this 13th day of May 2003. APPROVED, the said Variation. Approval is given subject to the following conditions: This order shall expire if not acted upon within 12 months of the date of making. "carried"
#6828 L. J. Berry – J. S. Hamilton RESOLVED that the Council of the Rural Municipality of South Cypress grant $125.00 to the Cypress River Agricultural Society to aid in its staging of their Annual Fair which is to be held on July 12th and 13th, 2003. "carried"
#6829 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize the purchase of 2 rolls of 18 ft. X 260 ft. and 2 rolls of 12 ft. X 360 ft. of woven poly geotextile fabric from Armtec Limited of Winnipeg, Manitoba at a cost of $399.00 plus taxes per roll (F.O.B. Glenboro). AND FURTHER BE IT RESOLVED that the said fabric be used this year in stabilizing frost boils on various Municipal roads throughout the Municipality. "carried"
#6830 W. J. Mooney – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress sponsor the Glenboro U.C.T. 2003 Bike Rodeo and thereby authorize a grant in the amount $20.00 for the purchase of bicycle helmet. "carried"
#6831 J. S. Hamilton – L. J. Berry RESOLVED that we authorize all Council members and the Chief Administrative Officer to attend the Association of Manitoba Municipalities Western District Annual Meeting to be held in Carberry, Manitoba on June 11th, 2003. "carried"
