Minutes of the ninth regular meeting of the 2003/2004 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, July 13, 2004 at 9:00 a.m. Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, in the chair, called the meeting to order at 9:00 a.m. During the meeting, at the time indicated, Council held the noted public hearings and met with the following delegations. #7078 L. E. Coates – W. R. Cullen RESOLVED that the minutes of the last regular meeting of Council held on Tuesday June 8, 2004 be taken as read and approved, all statutory requirements having been fulfilled. "carried"
#7079 W. R. Cullen – L. J. Berry RESOLVED that the Council of The Rural Municipality of South Cypress authorize the payment of fiscal year 2004 accounts from cheque #2007 to and including cheque #2085, as submitted to Council by the Municipal Administrator. "carried"
#7080 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize all Council members to attend the Tiger Hills Conservation District Annual Tour, which is to commence at Baldur, Manitoba at 9:00 a.m. on Thursday July 29, 2004. "carried" #7081 L. E. Coates – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress enter into an arrangement with Municipal Waste Management Ltd. of Goodlands, Manitoba, whereby all livestock producers in the R. M. of South Cypress would be able to access, at a fee of $54.00 per tonne delivered, the landfill site near Souris, Manitoba for the proper disposal of dead stock from their operations. "carried"
At a Public Hearing held at 11:00 a.m., in regard to Conditional Use application #CU9-04-SC, representation was made by Donna Knight. #7082 L. E. Coates – J. S. Hamilton UNDER THE PLANNING ACT CONDITIONAL USE ORDER NO. CU9-04-SC Whereas Madeliene Claeys, the owner of the property legally described as Pt. of the NE ¼ SEC. 7-7-15 WPM and located at approx. 9 miles West of Glenboro on P.T.H. #2 in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress for approval of a Conditional Use Order under Zoning By-Law No. 1485 Part IV, Section 6, Table IV-I, in order to: ALLOW THE ESTABLISHMENT OF A RURAL NON-FARM DWELLING SITE IN THE "A-80" AGRICULTURAL DISTRICT. and after careful consideration of the application and any representations made for or against it, the Council of the R. M. of South Cypress in a meeting duly assembled on the 13th day of July A.D; 2004, APPROVED the said application. Approval is given subject to the following conditions: Approval shall expire if not acted upon within 12 months of the date of making. "carried"
At a Public Hearing held at 11:00 a.m., in regard to Variation Order application #V5-04-SC, representation was made by Donna Knight. #7083 L. E. Coates – L. J. Berry VARIATION ORDER BY THE R. M. OF SOUTH CYPRESS VARIATION ORDER NO: V5-04-SC Whereas Madeliene Claeys, owner of the property legally described as Pt. of the NE 7-7-15 WPM, (South Cypress) and located at approximately nine miles West of Glenboro applied to the Council of the R. M. of South Cypress to vary the application of Part IV, Section 8, Zoning By-Law No. 1485 provided under Clause (A) of subsection (3) of Section 57 of the Planning Act as it applies to the property, in order to vary the established requirements, in accordance with the appended sketch as follows;
FROM: A minimum rear setback of: 25 Feet. TO: A rear setback of 5 feet. FOR THE PURPOSE OF: Allowing the existing location of the metal shed. And after careful consideration of the application and any representations made for or against the variation sought by the applicant, Madeliene Claeys The R. M. of South Cypress in meeting duly assembled this 13th day of July, 2004. APPROVED the said application.

At a Public Hearing held at 11:15 a.m., in regard to Conditional Use application #CU10-04-SC, representation made was by the applicant, Dennis Kowall. #7084 W. R. Cullen - L. J. Berry UNDER THE PLANNING ACT CONDITIONAL USE ORDER NO. CU10-04-SC Whereas Robert and Dennis Kowall, the owners of the property legally described as Pt. of the SE ¼ SEC. 15-8-16 WPM and located at approx. 2 miles Northeast of Treesbank in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress for approval of a Conditional Use Order under Zoning By-Law No. 1485 Part IV, Section 6, Table IV-I, in order to: ALLOW THE ESTABLISHMENT OF A RURAL NON-FARM DWELLING SITE IN THE "A-80" AGRICULTURAL DISTRICT. and after careful consideration of the application and any representations made for or against it, the Council of the R. M. of South Cypress in a meeting duly assembled on the 13th day of July A.D; 2004, APPROVED the said application. Approval is given subject to the following conditions: Approval shall expire if not acted upon within 12 months of the date of making. "carried" #7085 L. E. Coates – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize all Council members to attend the Assiniboine Regional Health Authority Public Meeting, regarding the future of Health care in the region, which will be held in Souris, Manitoba on Monday August 30, 2004. "carried" #7086 L. E. Coates – W. R. Cullen UNDER THE PLANNING ACT CONDITIONAL USE ORDER NO. CU8-04-SC Whereas Brent Cullen, the owner of the property legally described as Pt. of the SW ¼ SEC. 27-7-15 WPM and located at approx. 8 miles Northwest of Glenboro in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress for approval of a Conditional Use Order under Zoning By-Law No. 1485 Part IV, Section 6, Table IV-I, in order to: ALLOW THE ESTABLISHMENT OF A RURAL NON-FARM DWELLING SITE IN THE "A-80" AGRICULTURAL DISTRICT. and after careful consideration of the application and any representations made for or against it, the Council of the R. M. of South Cypress in a meeting duly assembled on the 13th day of July A.D; 2004, APPROVED the said application. Approval is given subject to the following conditions: Approval shall expire if not acted upon within 12 months of the date of making. "carried"
#7087 L. E. Coates – L. J. Berry VARIATION ORDER BY THE R. M. OF SOUTH CYPRESS VARIATION ORDER NO: V4-04-SC Whereas Brent Cullen, owner of the property legally described as Pt. of the SW 27-7-15 WPM, (South Cypress) and located at approximately eight miles Northwest of Glenboro applied to the Council of the R. M. of South Cypress to vary the application of Part IV, Section 8, Zoning By-Law No. 1485 provided under Clause (A) of Subsection (3) of Section 57 of the Planning Act as it applies to the property, in order to vary the established requirements, in accordance with the appended sketch as follows; FROM: A minimum front setback of: 125 Feet. TO: A front setback of 10 feet. FOR THE PURPOSE OF: Allowing the existing location of the mobile home. And after careful consideration of the application and any representations made for or against the variation sought by the applicant, Brent Cullen The R. M. of South Cypress in meeting duly assembled this 13th day of July, 2004. APPROVED the said varation. Approval is given subject to the following conditions: This order shall expire if not acted upon within 12 months of the date of making. "carried"

Cullen RESOLVED that the Council of The Rural Municipality of South Cypress authorize Accounting/Administrative Clerk, Maureena McPhail to register in the MMAA Certificate Program "Essentials of Management" (Course #23035 04-02) as offered by The University of Manitoba during the 2004/2005 Education Year. "carried"
