Minutes of the seventh regular meeting of the 2004/2005 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, May 10, 2005 at 8:00 a.m.

Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck.

Reeve Earl E. Malyon, presiding, called the meeting to order at 8:05 a.m.

 

During the meeting, at the time indicated, Council held the noted public hearing and met with the following delegations.

RESOLVED that the minutes of the last regular meeting of Council held on Tuesday April 12, 2005 be taken as read and approved, all statutory requirements having been fulfilled.

RESOLVED that the Council of The Rural Municipality of South Cypress authorize the payment of fiscal year 2005 accounts from cheque #2653 to and including cheque #2717, as submitted to Council by the Municipal Administrator.

RESOLVED that the Council of The Rural Municipality of South Cypress give second and third reading to By-law #1788 (School and Municipal Property Tax Levy for fiscal year 2005) and that it be signed by the Reeve and Municipal Administrator, sealed and delivered.

RESOLVED that the Council of the Rural Municipality of South Cypress apply to the Minister of Transportation and Government Services to construct paved slow speed turn-off lanes off of P.T.H. #2 at the intersection of Golf Club Drive.

RESOLVED that the Council of The Rural Municipality of South Cypress authorize a 2005 expenditure of up to $1,000.00 for labour and materials required in the installation of Municipal road signs (numbered sequence) on respective intersections with Provincial Trunk Highways #5 & #18, and Provincial Roads #340 and #342, lying within the Municipality.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize Manitoba Transportation & Government Services, in the spring of 2005, to apply a dust control product (approximately 2,400 litres of calcium chloride) onto 1,475 feet length of Provincial Road #530, along the Hamlet of Treesbank.

RESOLVED that the Council of The Rural Municipality of South Cypress revise its April 12, 2005 "OFFER TO PURCHASE" with terms and conditions to be fully specified in the formal purchase agreement, for the property described as Lot 9; Plan 1130 as fully recorded on Certificate of Title #1758189, 1.97 acres c/w buildings thereon, namely a 50’ x 100’ Quonset, Office building and weigh scale, and being submitted to the registered owner, Newfield Seeds Company Ltd. of Brandon, Manitoba.

RESOLVED that the Council of The Rural Municipality of South Cypress approve an increase in the services contract of Pine Creek Superseal Polyurethane Foam, of Austin, Manitoba for the supplying of all necessary labour and materials in insulating a 2,400 square foot area (ceiling and walls) in the north section of the Municipal shed with 4" (R28) #2 fire rated foam.

RESOLVED that the Council of The Rural Municipality of South Cypress accept an April 29, 2005 proposal submitted by Manitoba Transportation and Government Services whereby the Municipality would continue, for a further three years, to maintain, on behalf of the Province, approximately 5.5 miles of Provincial Road #530 lying North of P.T.H. #2 to Treesbank;

AND FURTHER BE IT RESOLVED that the Reeve and Chief Administrative Officer be authorized to sign a contract extension, with Manitoba Highways and Transportation for such maintenance and repair of the said 5.5 miles of Provincial Road #530 (from P.T.H. #2 to Treesbank) for the term January 1, 2006 to December 31, 2008.

RESOLVED that the Council of the Rural Municipality of South Cypress implement a grasshopper control program during the summer 2005 whereby all required road ditches/road allowances, infested with grasshoppers, will be treated with Eco Bran Insecticide via ground application;

AND FURTHER BE IT RESOLVED that the Council of The Rural Municipality of South Cypress authorize the Glenboro-South Cypress Weed Control District to apply, this season, the said Eco Bran Grasshopper Bait onto required/designated Municipal ditches/road allowances, at the rate of $50.00 per hour.

RESOLVED that the Council of The Rural Municipality of South Cypress grant $ 125.00 to the Cypress River Agricultural Society to aid in its staging of their 110th Annual Exhibition which is to be held on July 16th and 17th, 2005.

RESOLVED that the Council of The Rural Municipality of South Cypress renew its membership with the Southwest Regional Development Corporation for the year 2005.

RESOLVED that the Council of The Rural Municipality of South Cypress request Disaster Financial Assistance from the Provincial Government for Owners/Lessees of cultivated/hay land in the Spruce Woods Provincial Park Area and in the Treesbank area affected by flooding of the Assiniboine River and the Souris River in the Spring of 2005.

UNDER THE PLANNING ACT

CONDITIONAL USE ORDER NO. CU 1-05-SC

Whereas Brian and Linda Naismith, the owners of the property legally described as Pt. of the SE 1/4 Section 16-7-14 WPM and located at immediately adjacent to Glenboro (NW Corner) in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress for approval of a Conditional Use Order under Zoning By-Law No. 1485 Part IV, Section 6, Table IV-I, in order to:

ALLOW THE ESTABLISHMENT OF A RURAL NON-FARM DWELLING

SITE IN THE "A-80" AGRICULTURAL DISTRICT. [Approx. 13.5 Acres]

and after careful consideration of the application and any representations made for or against it, the Council of the R. M. of South Cypress in a meeting duly assembled on the 10th day of May A.D., 2005,

APPROVED the said application.

Approval is given subject to the following conditions: None

Approval shall expire if not acted upon within 12 months of the date of making.

RESOLVED that the Council of The Rural Municipality of South Cypress award an academic scholarship, in the amount of $ 200.00 for the most deserving year 2005 Graduating Class Student from the Glenboro School who enters post secondary education in Agriculture or Human Ecology or enters a recognized community college, and also award an academic scholarship, in the amount of $ 200.00 for the most deserving year 2005 Graduating Class Student from the Wawanesa School who enters post secondary education in Agriculture or Human Ecology or enters a recognized community college.

RESOLVED that the Council of The Rural Municipality of South Cypress give final approval to the merging of the offices of the Rural Municipality of South Cypress and the Village of Glenboro into a single shared administrative office with associated administrative staff, to take effect as soon as feasible in the summer of 2005, subject to the Council of the Village of Glenboro giving like approval for same;

AND FURTHER BE IT RESOLVED that the Council of the Rural Municipality of South Cypress appoint Reeve Earl E. Malyon and Councillor John S. Hamilton to a joint four member Municipal/Village Steering Committee empowered to attend to details of the said merger.
