Minutes of the fourth regular meeting of the 2005/2006 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Ave. Glenboro, Manitoba on Tuesday, February 14, 2006 at 9:00 a.m. Present at the meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen, Chief Administrative Officer, Eric Plaetinck and Assistant CAO Darren Myers. Reeve Earl E. Malyon, presiding, called the meeting to order at 9:05 a.m. During the meeting, at the time indicated, Council met with the following delegations and conducted the noted public hearing. #7488 L. E. Coates – W. J. Mooney RESOLVED that the minutes of the last regular meeting of Council held on Tuesday January 10, 2006 be taken as read and approved, all statutory requirements having been fulfilled. "carried"
#7489 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-Law #1795 (vis-à-vis appointment of the 2006 Chief Administrative Officer) and that it be signed by the Reeve and Chief Administrative Officer, sealed and delivered. "carried"
#7490 L. E. Coates – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2005 accounts from cheque #3200 to and including cheque #3207 as submitted to Council by the Chief Administrative Officer. "carried"
#7491 W. J. Mooney – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress adopt the Municipality’s Financial Statement for fiscal year ending December 31, 2005, as presented by the Chief Administrative Officer, showing a net operating deficit of $ 21, 897.04. "carried"
#7492 L. E. Coates – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2006 accounts from cheque #3259 to and including cheque #3312, as submitted to Council by the Chief Administrative Officer. "carried"
#7493 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize Equipment Operators; Ed Berry, Allan Bartram and Paul Wilton to attend the Manitoba Good Roads Association Seminar entitled "Dust Control and Geo-textiles" being held on Monday February 27, 2006 in Brandon. "carried"
#7494 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress ratify the material/service costs incurred and the Equipment Operator’s time spent, during the winter of 2005/2006, associated in the conversion of the north end of the Municipal Equipment Shed into a heated work area (30’ x 40’) c/w mezzanine floor storage/shelving and bathroom & office quarters. "carried"
#7495 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress apply to Manitoba Transportation and Government Services for a year 2006 grant of up to $1,251.80 for improvements to a designated portion of Provincial Road #530, North of P.T.H. #2 to the Hamlet of Treesbank.

Mooney RESOLVED that the Council of the Rural Municipality of South Cypress authorize the Municipal Equipment Operators to submit a tender in an amount at their discretion upon their examination, for the purchase of a used 1991 Miller portable welder c/w 8,000 watt generator located at the Holland School Bus Garage and owned by the Prairie Spirit School Division. "carried"
#7497 L. E. Coates – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize all members of Council and the Municipal Administrator to attend a one-day seminar on Municipal Weed Control Issues, being hosted by Manitoba Agriculture and the Manitoba Weed Supervisors Association, which is to be held in Holland, Manitoba on Wednesday, March 22, 2006. "carried"
#7498 J. S. Hamilton – L. J. Berry RESOLVED that the year 2006 Spring road restrictions, for designated municipal roads within the limits of the R. M. of South Cypress, will commence on or after March 15, 2006; (actual implementation date dependent on weather conditions) and shall remain in effect for a period of up to ten weeks, as deemed necessary by Council. The following specified municipal roads, lying within the Rural Municipality of South Cypress, which are classified as a "B Highway", shall be weight restricted, when so posted, to 65% of normal axle loads: 1 mile of Public Road lying within Section 3; Township 7; Range 14 WPM, referred to as the I.P.L Road, and 3 miles of Public Road lying directly North of Sections 25 & 26; Township 7; Range 14 WPM and directly North of Section 30; Township 7; Range 13 WPM, and 7 miles of Public Road #78W from P.T.H #2 to Municipal Road #45N With the exception of the above noted roads, all other municipal roads, within the limits of the Rural Municipality of South Cypress will not be subject to spring weight restrictions. At a Public Hearing held at 11:30 a.m., in regard to Conditional Use application #CU1-06-SC, no representation was made either for or against the application.
#7499 J. S. Hamilton – L. J. Berry UNDER THE PLANNING ACT CONDITIONAL USE ORDER NO. CU1-06-SC WHEREAS Joan Neale, the proposed owner of the property legally described as Part of the SE ¼ Section 12-8-14 WPM and located at approximately 6 miles North East of Glenboro in the Rural Municipality of South Cypress, applied to the Council of the R. M. of South Cypress for approval of a conditional use order under zoning By-Law No.1485, Part IV, Section 6 Table IV-I, in order to: Allow the establishment of a rural non-farm dwelling site in the "A80 Agricultural District, (Approximately 10.0 Acres) And after careful consideration of the application and any representations made for or against it, the Council of the Rural Municipality of South Cypress in a meeting duly assembled on the 14th day of February A.D., 2006. APPROVED the said application. Approval is given subject to the following conditions: "none specified" Approval shall expire if not acted upon within 12 months of the date of making. "carried"

Mooney RESOLVED that the Council of the Rural Municipality of South Cypress acknowledge the 2005 financial statement of the Cypress River Memorial Hall Committee and accept a year 2006 operating levy requirement of $1,163.00 from the Rural Municipality of South Cypress. "carried"
#7501 L. E. Coates – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress contract the services of Truelove Electric of Cypress River to upgrade the electrical service panels, meter and associated wiring of the Municipal/Village Office in order to bring same up to electrical code standards and also to accommodate the emergency generator switchover, at and for the quoted estimated cost of $1,700.00 plus applicable taxes. "carried"
#7502 W. R. Cullen – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress support Sport Manitoba’s Westman Region Kidsport Committee in their ongoing "Kidsport" program whereby funding is provided to financially disadvantaged children in the Westman area so they may be able to participate in Community sports, AND FURTHER BE IT RESOLVED that the Council of the Rural Municipality of South Cypress authorize a 2006 Municipal grant in the amount of $100.00 to aid in augmenting the Sport Manitoba Westman Region’s Kidsport Trust Fund. "carried"
#7503 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress jointly with the Council of the Village of Glenboro, and in accordance with Section 10(1) and Section 10(2) of "The Municipal Councils and School Boards Election Act", appoint area resident/ratepayer Agnes Witherspoon of Glenboro, Manitoba as "Senior Election Official" for the Rural Municipality of South Cypress and the Village of Glenboro commencing February 14th, 2006, AND FURTHER BE IT RESOLVED that said Senior Election Official, Agnes Witherspoon and Municipal/Village Chief Administrative Officer, Eric Plaetinck be authorized to attend the Manitoba Intergovernmental Affairs Municipal Election Seminar being held in Souris, Manitoba on Tuesday, April 25th, 2006. #7504 W. J. Mooney – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize a $500.00 grant to the Seniors Independent Services Board to aid in offsetting their operational costs during the year 2006. "carried"
#7505 L. E. Coates – W. J. Mooney WHEREAS as provided for in Section 365(2) of the Municipal Act, a Council may in any year designate the immediately preceding year or any earlier year as the year for which properties the taxes in respect of which are in arrears for the year must be offered for sale by auction to recover the tax arrears and costs; NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress, designate Tax Year 2005 as the year for which properties the taxes in respect of which are in arrears (2004 taxes) must be fully paid prior to commencement of the 2006 Municipal Tax Sale and failing payment of all 2004 tax arrears the respective property will be offered for sale by auction in order to recover the tax arrears and costs; AND FURTHER BE IT RESOLVED that the Rural Municipality of South Cypress conduct this year’s Municipal Tax Sale at a suitable date & time, in the fall of the year 2006, as determined by the Chief Administrative Officer. #7506 W.J. Mooney – W. R. Cullen WHEREAS the Governments of Canada and Manitoba want to support the future prosperity of Municipalities in the Province of Manitoba based on a long term vision of sustainability, and WHEREAS Canada and Manitoba recognize the need to work in partnership to address the local infrastructure investment needs of Municipalities through stable and predictable funding for Municipal infrastructure; and WHEREAS Canada and Manitoba have entered into an Agreement on the Transfer of Federal Gas Tax Revenues under the New Deal for Cities and Communities dated November 18, 2005 (New Deal Gas Tax Agreement) and WHEREAS Manitoba has agreed to administer the funds made available pursuant to the New Deal Gas Tax Agreement on behalf of Canada; and WHEREAS Manitoba had agreed to conditionally provide the funds to the Municipality, subject to receipt of funds from Canada as agreed to under the New Deal Gas Tax Agreement and as set out in the agreement; and WHEREAS these funds are to be used by the Municipality towards the eligible costs of environmentally sustainable Municipal infrastructure projects; and WHEREAS the Municipality has agreed to accept these funds upon the terms and conditions contained in the Funding Agreement; NOW THEREFORE BE IT RESOLVED THAT the Council of the Rural Municipality of South Cypress authorize the Reeve and Chief Administrative Officer to sign forthwith the said Gas Tax Funding Agreement with the Province of Manitoba, attached hereto and marked as Appendix "A." "carried"
#7507 W. R. Cullen – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize Reeve Earl E. Malyon, Deputy Reeve John S. Hamilton and Chief Administrative Officer Eric Plaetinck to attend the A.M.M. Western District 2006 Mayors, Reeves & CAO’s meeting which is to be held in Ninette, Manitoba on March 21, 2006. "carried"
#7508 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize Reeve Earl E. Malyon to attend the Federation of Manitoba Municipalities’ workshop entitled "Land Management in Local Communities; Opportunities and Challenges for First Nation – Municipal Government Relations in Manitoba" which is to held in Winnipeg, Manitoba on Wednesday, February 22nd, 2006. "carried"
#7509 L. E. Coates – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress hold a special meeting on Monday April 3, 2006 at 10:00 a.m. to set and adopt the Municipality’s Budgeted Operating Expenditures for fiscal year 2006. AND FURTHER BE IT RESOLVED that in compliance with Section 162(2) of The Municipal Act, the Council of the Rural Municipality of South Cypress hold a Public Hearing on Tuesday, April 11, 2006 at 1:30 p.m. in the R. M. of South Cypress Council Chambers at Glenboro, Manitoba for the purpose of presenting its Financial Plan for fiscal year 2006 and subsequently giving any person who wishes, opportunity to make representation, ask questions or register an objection to the Financial Plan so presented.
