Minutes of the eleventh regular meeting of the 2001/2002 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, September 10, 2002 at 8:00 a.m.

Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, W. Jack Mooney, and Chief Administrative Officer, Eric Plaetinck.

Reeve Earl E. Malyon, in the chair, called the meeting to order at 8:05 a.m.

During the meeting, at the time indicated, Council met with the following delegations.

RESOLVED that the minutes of the last meeting of Council held on Tuesday August 13, 2002 be taken as read and approved, all statutory requirements having been fulfilled.

RESOLVED that the Council of The Rural Municipality of South Cypress authorize the payment of fiscal year 2002 accounts from cheque #677 to and including cheque #723, as submitted to Council by the Chief Administrative Officer.

WHEREAS the Municipality’s 1999 Champion Model 740A Motor Grader, serial #29435, was totally destroyed by lightning/fire on August 8, 2002;

AND WHEREAS Council has been advised by Municipal insurance brokerage firm, Hayhurst Elias Dudek Inc. that a replacement value of up to $214,396.00 plus applicable taxes, has been approved by the insurance adjusting firm of James Dube Spraggs Ltd. to cover the purchase of a new replacement motor grader;

NOW THEREFORE BE IT RESOLVED that the Council of The Rural Municipality of South Cypress purchase a new 2003 Caterpillar 140H Motor Grader c/w a used IMAC hydraulic wing and a 5 year/7500 hour power train warranty, from Toromont Cat of Winnipeg, Manitoba for the total cash price of $222,000.00 plus applicable taxes and as per particulars specified in an August 23, 2002 sales agreement.

WHEREAS the Rural Municipality of South Cypress and The Rural Municipality of Oakland have been given all necessary Federal and Provincial approvals in order to proceed with the immediate replacement of the deteriorated bridge, crossing Five Mile Creek on the Town Line between Section 24-8-17 W and Section 19-8-16W;

NOW THEREFORE BE IT RESOLVED that the Council of The Rural Municipality of South Cypress jointly with the Council of the Rural Municipality of Oakland authorize the forthwith purchase of a 142 inch diameter x 60 ft. long 10 gauge culvert from Westman Steel Industries Ltd. at a cost of $11,100.00 plus applicable taxes, FOB site;

AND FURTHER BE IT RESOLVED that Wawanesa Backhoe Service of Wawanesa, Manitoba be contracted, as soon as possible, to provide all labour and equipment required for the complete bridge demolition/removal and subsequent culvert installation, at a cost of $12,557.50 plus applicable taxes, and as per further particulars specified in the September 6, 2002 quote.

RESOLVED that the Council of The Rural Municipality of South Cypress contract the services of Bradley Sand & Gravel Ltd. of Brandon, Manitoba to crush and stockpile 15,000 cubic yards of crushed gravel at the Craig Bell gravel pit (SW ¼ 10-8-16W) for the quoted/agreed price of $2.10 plus G.S.T. per cubic yard;

AND FURTHER RESOLVED that the crushing of the said 15,000 cubic yards of gravel be undertaken this fall, or as soon as possible thereafter, at the contractors choice/convenience, and accordingly billing and payment of same be deferred to July 1, 2003.

WHEREAS a group of area landowners in the Northfield School District are experiencing difficulty in obtaining a convenient and dependable source of water for their livestock production operations;

AND WHEREAS these landowners wish to explore, via test hole drilling, the immediate area in order to determine which exact site would be the most suitable for the establishment of a permanent well with the best quantity of water;

NOW THEREFORE BE IT RESOLVED that the Council of The Rural Municipality of South Cypress authorize exploratory well test drilling on the undeveloped Municipal Road allowance between the SE ¼ of Section 21 and the SW ¼ of Section 22; in Township 7; Range 16 WPM

AND FURTHER BE IT RESOLVED that, based on test drilling results, if the most suitable site for such a water source lies under the said road allowance then the said landowners group will be required to make a formal application to the Municipality of the proposed well project and associated water pipeline.

RESOLVED the Property Assessments as listed under Schedule "A" be added to the R. M. of South Cypress’ 2002 GIL Assessment Roll under the authority of Section 321(1) of the Municipal Act:

AND FURTHER BE IT RESOLVED that the additional GIL of taxes thereon as set out in Schedule "B" be added to their respective property within the Rural Municipality of South Cypress, as added Grant in Lieu of Taxes for Year 2002 under the authority of Section 321(1) of the Municipal Act.

RESOLVED that the Council of The Rural Municipality of South Cypress recognizes the forthcoming Glenboro Lady Sahara Bonspiel on November 8 – 10, 2002 as a community event and thereby authorizes the Glenboro Curling Club to make application to the Manitoba Liquor Control Commission for permission to operate under one of South Cypress’ 2002 Community permits.

RESOLVED that the Council of The Rural Municipality of South Cypress authorize the Administrative staff to attend the Municipal Administrators Association District 2 Meeting to be held at Pembina Crossing, Manitoba on Thursday September 19, 2002.

RESOLVED that the Council of the Rural Municipality of South Cypress do now adjourn @ 11:35 a.m., to convene again at the next regular Council meeting scheduled for Tuesday, October 8, 2002 at 9:00 a.m.
