Minutes of the fourth regular meeting of the 2001/2002 Council
of the Rural Municipality of South Cypress held in the Municipal Council
Chambers at 618 Railway Avenue, Glenboro, Manitoba on Tuesday, February 12, 2002
at 9:00 a.m.
Present at the Meeting, Reeve Earl E. Malyon, Councillors
Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney and Chief
Administrative Officer, Eric Plaetinck.
Reeve Earl E. Malyon, in the chair, called the meeting to
order at 9:00 a.m.
During the meeting, at the time indicated, Council conducted
the noted public hearings and also met with the following delegations.

RESOLVED that the minutes of the last regular meeting of
Council held on Tuesday January 8, 2002 be taken as read and approved, all
statutory requirements having been fulfilled.

RESOLVED that the Council of The Rural Municipality of South
Cypress adopt the Municipality’s Financial Statement for Fiscal Year ending
December 31, 2001, as presented by the Chief Administrative Officer, showing a
Net Operating Surplus of $28,023.19.
AND FURTHER BE IT RESOLVED that $15,000.00 of the said
surplus, which was realized from the cash sale of a 1991 Landini 8880 Tractor,
be transferred into the Municipality’s Machinery & Equipment Replacement
Reserve, under the authority of Section 164(5) of the Municipal Act.

RESOLVED that the Council of The Rural Municipality of South
Cypress authorize the payment of fiscal year 2002 accounts from cheque #305
to and including cheque #353, as submitted to Council by the
Chief Administrative Officer.

RESOLVED that the Council of The Rural Municipality of South
Cypress authorize Municipal Equipment Operators Edwin Berry, H. Wayne Johnson
and Allan Bartram to attend the Manitoba Good Roads Association Workshop, and
the A.M.M. Trade Show, which are both being held in Brandon, Manitoba on
Monday, February 18, 2002. "carried"

RESOLVED that the Council of The Rural Municipality of South
Cypress accept a January 30, 2002 proposal submitted by Manitoba Highways and
Transportation whereby the Municipality would continue, for a further three
years, to maintain, on behalf of the Province, approximately 5.5 miles of
Provincial Road #530 lying North of P.T.H. #2 to Treesbank;
AND FURTHER BE IT RESOLVED that the Reeve and Chief
Administrative Officer be authorized to sign a contract extension, with
Manitoba Highways and Transportation for such maintenance and repair of the
said 5.5 miles of Provincial Road #530 (from P.T.H. #2 to Treesbank) for the
term January 1, 2003 to December 31, 2005.

RESOLVED that the Council of The Rural Municipality of South
Cypress apply to Manitoba Highways and Transportation for a year 2002 grant of
up to $1,098.90 for improvements to a portion of P.R. #530 at Treesbank,
consisting of building up the road base with shale.

RESOLVED that the Council of the Rural Municipality of South
adopt the following policy forthwith;
No Dirt, Sand or Gravel is to be removed from any Municipal
Road allowance, whether developed or not, unless first authorized by the
Council of the Rural Municipality of South Cypress.
AND FURTHER BE IT RESOLVED that any such aggregate removed
by the permittee, shall be charged at the rate of 50 cents per cubic yard,
subject to section 292 of the Municipal Act.

RESOLVED that the year 2002 spring road restrictions, for
designated municipal roads within the limits of the R. M. of South Cypress,
will commence on or after March 15, 2002; (actual implementation date
dependent on weather conditions) and shall remain in effect for a period of
six to eight weeks.
The following specified municipal road, lying within the
Rural Municipality of South Cypress, which is classified as a "B
Highway", shall be weight restricted, when so
posted, to 65% of normal axle loads;
1 mile of Public road lying within Section 3; Township 7;
Range 14 WPM, referred to as the I.P.L Road, and 3 miles of Public Road lying directly North of Sections 25
& 26; Township 7; Range 14 WPM and Directly North of Section 30; Township 7; Range 13 WPM.
With the exception of the above noted roads, all other
municipal roads, within the limits of The Rural Municipality of South Cypress
will not be subject to spring weight restrictions.

At a Public Hearing held at 1:15 p.m., in regard to
Conditional Use application file #CU3-02-SC, no representation was made either
for or against the said application.

CONDITIONAL
USE ORDER NO. CU3-02-SC
WHEREAS Bill & Georgina Gullett, the owners of the
property legally described as PT. Of the SW ¼ Section of 6-7-16 WPM and
located at approx. 2 miles south of the junction of PTH #2 and PTH #18 in
the R.M. of South Cypress, applied to the Council of The R.M. of South
Cypress for approval of a Conditional Use under Zoning By-Law No. 1485, Part
IV, Section 6, Table IV-II, in order to:
Provide for the establishment of a rural non-farm dwelling
site in the "A80" agricultural district,
And after careful consideration of the application and any
representations made for or against it, The Council of The R.M. of the South
Cypress in a meeting duly assembled on the 12th day of February
AD; 2002
APPROVED the said application.
Approval is given subject to the following condition:
Approval shall expire if not acted upon within 12 months
of the date of making.

At a Public Hearing held at 1:30 p.m., in regard to
Conditional Use application file #CU2-02-SC & Variation Order No.
V2-02-SC representation was made by Alf Poetker, P. Eng. of Cochrane
Engineering Ltd. of Winnipeg, Manitoba.
Upon conclusion of the Public Hearing, Council decided to
defer a resolution on the said applications, until a later date.

RESOLVED that the Council of The Rural Municipality of
South Cypress authorize any member of Council and the C.A.O. to attend a
one-day Seminar, on Municipal Weed Control Issues, being hosted by Manitoba
Agriculture and the Manitoba Weed Supervisors Association, which is to be
held in Holland, Manitoba on Wednesday, March 20, 2002.

RESOLVED that the Council of The Rural Municipality of
South Cypress accept the 2001 Financial Statement of the Cypress River
Memorial Hall Committee and approve a year 2002 levy request from the Rural
Municipality of South Cypress in the amount of $1,036.00.

RESOLVED that the Council of The Rural Municipality of
South Cypress award a grant in the amount of $ 675.00 to the Wawanesa-Oakland
Community Development Corporation to aid in its operational costs associated
with Wawanesa Community Promotional Activities during the year 2002.

WHEREAS as provided for in Section 365(2) of the Municipal
Act, a Council may in any year designate the immediately preceding year or
any earlier year as the year for which properties the taxes in respect of
which are in arrears for the year must be offered for sale by auction to
recover the tax arrears and costs;
NOW THEREFORE BE IT RESOLVED that the Council of the Rural
Municipality of South Cypress, designate Tax Year 2001 as the year for which
properties the taxes in respect of which are in arrears (2000 Taxes) must be
fully paid prior to commencement of the 2002 Municipal Tax Sale and failing
payment of all 2000 tax arrears the respective property will be offered for
sale by auction in order to recover the tax arrears and costs;
AND FURTHER BE IT RESOLVED that the Rural Municipality of
South Cypress hold its 2002 Tax Sale at an appropriate date in the Fall, of
the year 2002.

RESOLVED that the Council of The Rural Municipality of
South Cypress renew its Certificates of Insurance coverage for period
January 1, 2002 to December 31, 2002 under the U.M.M. Municipal General
Insurance Program thru the Insurance Brokerage Firm of H.E.D. Hayhust Elias
Dudek Inc. and thereby pay the respective premium of $ 20,192.00, (an
increase of 35%) which is based on coverage and values specified in the said
certificate.
AND FURTHER BE IT RESOLVED THAT Council elect to reduce
the said insurance policy’s standard deductible of $2,500.00 on
physical/additional annual cost of $1,010.00.

RESOLVED that the Council of The Rural Municipality of
South Cypress do now adjourn @ 4:05 p.m., to meet again for our regular
scheduled meeting for Tuesday, March 12, 2002, at 9:00 a.m.
