Minutes of the third regular meeting of the 2002/2003 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Avenue, Glenboro, Manitoba on Tuesday, January 14, 2003 at 9:00 a.m.

Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen andChief Administrative Officer, Eric Plaetinck.

Reeve Earl E. Malyon, in the chair, called the meeting to order at 9:05 a.m.

During the meeting, at the time indicated, Council met with the following delegations.

RESOLVED that the minutes of the last regular meeting of Council held on Tuesday December 10, 2002 be taken as read and approved, all statutory requirements having been fulfilled.

RESOLVED that the Council of The Rural Municipality of South Cypress authorize the payment of fiscal year 2002 accounts from cheque #908 to and including cheque #959, as submitted to Council by the Chief Administrative Officer.

UNDER THE PLANNING ACT

VARIATION ORDER BY THE R. M. OF SOUTH CYPRESS

VARIATION ORDER NO: V2-02-SC

WHEREAS TREESBANK COLONY FARMS owner of the property legally described as PT. Of the NE 31-7-16 WPM, R. M. of South Cypress and located at approximately one mile southwest of Treesbank applied to the Council of the R. M. of South Cypress to vary the application of PART IV, SECTION 8, ZONING BY-LAW NO. 1485 provided under Clause (A) of Subsection (3) of Section 57 of The Planning Act as it applies to the property, in order to vary the established requirements as follows:

FROM: A minimum front yard setback of: 125 feet.

TO: A front setback of 15 feet.

FOR THE PURPOSE OF: Accommodating the construction of a domestic Sewage Lagoon.

And after careful consideration of the application and any representations made for or against the variation sought by the applicant, TREESBANK COLONY FARMS

the Council of the R. M. of South Cypress in meeting duly assembled

this 14th day of January, 2003

UNDER THE PLANNING ACT

CONDITIONAL USE ORDER NO. CU2-02-SC

Whereas TREESBANK COLONY FARMS the owners of the property legally described as Pt. of the NE Ό SEC. 31-7-16 WPM and located at approx. 1 mile South West of the Village of Treesbank in the R. M. of South Cypress applied to the Council of the R. M. of South Cypress for approval of a Conditional Use under Zoning By-Law No. 1485 Part IV, Section 6, Table IV-II, in order to:

PROVIDE FOR THE ESTABLISHMENT OF A SEWAGE WASTE LAGOON (DOMESTIC) SITE IN THE "A80" AGRICULTURAL DISTRICT,

and after careful consideration of the application and any representations made for or against it, the Council of the R. M. of South Cypress in a meeting duly assembled on the 14th day of January AD; 2003

APPROVED the said application.

Approval is given subject to the following conditions:

1. Treesbank Colony Farms agrees to comply with the Environment Act license #2579.

2. Treesbank Colony Farms will provide on an annual basis, copies of the records of wastewater sampling dates, copies of the wastewater sampling results provided by the accredited laboratory and effluent discharge dates.

3. If, in the opinion of the Council of the R. M. of South Cypress, evidence warrants further investigation by way of sampling, then council reserves the right to initiate additional sampling by independent consultants.

4. If evidence reveals problems, then Council will investigate and pursue remedial action needed to mitigate the problem.

5. The costs of further sampling and investigation will be the responsibility of Treesbank Colony Farms Ltd.

Approval shall expire if not acted upon within 12 months of the date of making.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize Reeve Earl Malyon and Councillors W. Jack Mooney and Walter R. Cullen to attend the 2003 Manitoba Planning Conference being held in Brandon, Manitoba on March 13 & 14, 2003.

RESOLVED that the Council of the Rural Municipality of South Cypress grant $675.00 to the Wawanesa-Oakland Community Development Corporation, in support of its operations of economic development activities for the Wawanesa Community during the year 2003.

RESOLVED that the Council of The Rural Municipality of South Cypress renew its agreement with the Village of Wawanesa for the "Right of Use" of the Wawanesa Waste Disposal Grounds & Transfer Station by approximately 200 persons residing in the western portion of the Municipality;

AND FURTHER BE IT RESOLVED the Rural Municipality of South Cypress pay $ 30.00 per capita per year, to the Village of Wawanesa, for the privilege of utilizing the said facility;

AND FURTHER BE IT RESOLVED that this agreement shall be in effect as at January 1, 2003 with the term, rates and conditions of the said agreement being subject to review at any time by either the Villageof Wawanesa or the Rural Municipality of South Cypress.

AND FURTHER BE IT RESOLVED that the Council of The Rural Municipality of South Cypress value this gift-in-kind at $1,200.00.

RESOLVED that the Council of the Rural Municipality of South Cypress renew its Certificates of Insurance coverage for period January 1, 2003 to December 31, 2003 under the A.M.M. Municipal General Insurance Program thru the Insurance Brokerage Firm of H.E.D. Hayhurst Elias Dudek Inc. and thereby pay the respective premium of $27,198.00 (an increase of 28%) which is based on coverage and values specified in certificate number AMM036, dated January 7, 2003.

Ratepayers - $ 0.15 cents per copy

Clubs/Organizations - $ 0.15 cents per copy

Non-Ratepayers - $ 0.25 cents per copy

RESOLVED that the Council of The Rural Municipality of South Cypress set the rate of $0.50 per page for each page faxed, to a Canadian or American destination, with the Municipality’s fax machine during the year 2003.

RESOLVED that the Council of The Rural Municipality of South Cypress authorize its Council Members to participate in a series of Professional Development Seminars for Elected Officials, being presented by Manitoba Intergovernmental Affairs in co-operation with the Association of Manitoba Municipalities, which will be offered at various locations and dates during the year 2003.

AND FURTHER BE IT RESOLVED that the Council of The Rural Municipality of South Cypress authorize the pre-registering of six courses, at this time, at a cost of $50.00 per course per Council Member.
