Minutes of the tenth regular meeting of the 2003/2004 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, August 10, 2004 at 9:00 a.m.

Present at the Meeting, Deputy Reeve John S. Hamilton, Councillors Leonard J. Berry, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen, and Municipal Administrator, Eric Plaetinck.

Deputy Reeve John Hamilton in the chair, called the meeting to order @9:00 a.m.

During the meeting, at the time indicated, Council met with the following delegations.

RESOLVED that the minutes of the last meeting of Council held on Tuesday July 13, 2004 be taken as read and approved, all statutory requirements having been fulfilled.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2004 accounts from cheque #2086 to and including cheque #2129, as submitted to Council by the Municipal Administrator.

WHEREAS dangerous and reckless driving incidents have been recently experienced in the Municipality;

NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress request the Treherne Detachment of the Royal Canadian Mounted Police to firmly warn identified Municipal residents, that the dangerous driving habits which they have exhibited in the past will no longer be tolerated and if continued will be dealt with to the full extent of the law.

RESOLVED that the Plan of Subdivision of Land described as follows;

Being Part of the North ½ of Section 28, Township 7, Range 16W1, as shown on a drawing and being attached to an "Application for Subdivision" file #14-4187-04-4049 and being submitted by Leonard & Luella Plett;

That a Conditional Use Order be obtained to authorize the 18-acre non-farm dwelling site within the "A80" zone.

That a Variation Order be obtained to authorize the reduction in size of the residual agricultural parcel to 40 acres.

That a Variation Order(s) be obtained to authorize the reduction, where required, for the setback of existing building(s) on the 18 acre non-farm dwelling parcel and the 2 acre residual parcel, as to be determined by a legal land survey.

That the 2 residual portions of the property be shown as separate parcels on the plan of survey, and that they be on separate Certificate of Titles.

That if an off-site well is to be installed, that an easement agreement is to be registered as a caveat to provide for the continued use of the off-site water supply.

That an easement agreement be provided for the agricultural access to Legal Subdivision 15 of Section 28-7-16W.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the purchase of a used portable toilet, for the Stockton Ferry camping grounds, from C & C Rentals Ltd. of Brandon, Manitoba, at a total cost of $ 700.00 plus applicable taxes.

RESOLVED that the Council of the Rural Municipality of South Cypress place an advertisement in the 2005 Glenboro-South Cypress Trail Association Community Calendar, at a cost of $50.00.

RESOLVED that the Council of the Rural Municipality of South Cypress renew its membership with Agriculture in the Classroom, and thereby authorize the payment of the 2004 supporter fee of $150.00.

RESOLVED That the Property Assessments as listed under Schedule "B" be added to the R. M. of South Cypress’ 2004 Assessment Roll under the Authority of Section 321(1) of the Municipal Act:

AND FURTHER BE IT RESOLVED that the additional taxes thereon as set out in Schedule "C" be added to their respective property within the Rural Municipality of South Cypress, as added taxes for Year 2004 under the Authority of Section 321(1) of the Municipal Act.

RESOLVED that the Council of the Rural Municipality of South Cypress confirm a reservation with PLACE LOUIS RIEL of Winnipeg, Manitoba for a total of 7 standard one bedroom suites, which will be required by Council Members and the CAO in conjunction with their attendance of the A.M.M. Annual Convention to be held in Winnipeg, Manitoba on November 22 – 25, 2004 and accordingly authorize the payment by September 21, 2004 of a deposit for the first night’s room rate and taxes for all 7 rooms.
