Minutes of the fourth regular meeting of the 2003/2004 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Avenue, Glenboro, Manitoba on Tuesday, February 10, 2004 at 9:00 a.m.

 

Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck.

 

Reeve Earl E. Malyon, in the chair, called the meeting to order at 9:05 a.m.

 

During the meeting, at the time indicated, Council met with the following delegations.

RESOLVED that the minutes of the last regular meeting of Council held on Tuesday January 13, 2004 be taken as read and approved, all statutory requirements having been fulfilled.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2003 accounts from cheque #1686 to and including cheque #1690, as submitted to Council by the Chief Administrative Officer.

RESOLVED that the Council of the Rural Municipality of South Cypress adopt the Municipality’s Financial Statement for Fiscal Year ending December 31, 2003, as presented by the Chief Administrative Officer, showing a net Operating Surplus of $35,651.37.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2004 accounts from cheque #1712 to and including cheque #1765, as submitted to Council by the Chief Administrative Officer.

RESOLVED that the Council of the Rural Municipality of South Cypress accept the tender submitted by Wheat City Concrete Products of Brandon, Manitoba for the purchase of a used 1997 Peterbilt Model 378 Highway Tractor, serial number 1XP-FDB9X-8-VD432702, c/w wet kit, in "as is" safetied condition.

RESOLVED that the Council of the Rural Municipality of South Cypress appeal to Transport Canada to enforce, forthwith, the 1967 order in Council, which requires the installation of retro-reflective tape onto all railway cars in use in Canada.

RESOLVED that the year 2004 spring road restrictions, for designated municipal roads within the limits of the R. M. of South Cypress, will commence on or after March 15, 2004; (actual implementation date dependent on weather conditions) and shall remain in effect for a period of six to eight weeks.

The following specified municipal roads, lying within the Rural Municipality of South Cypress, which is classified as a "B Highway", shall be weight restricted, when so posted, to 65% of normal axle loads;

1 mile of Public road lying within Section 3; Township 7; Range 14 WPM, referred to as the I.P.L Road, and

3 miles of Public Road lying directly North of Sections 25 & 26; Township 7; Range 14 WPM and directly North of Section 30; Township 7; Range 13 WPM.

With the exception of the above noted roads, all other municipal roads, within the limits of the Rural Municipality of South Cypress will not be subject to spring weight restrictions.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize a $ 200.00 grant to the Glenboro-South Cypress Heritage Advisory Committee to aid in its operations during the year 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress grant the Tiger Hills Arts Association office space within the Municipal office building during the period September 1, 2004 to September 1, 2005;

AND FURTHER BE IT RESOLVED that the Council of the Rural Municipality of South Cypress value this gift-in-kind at $1,200.00.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize all members of Council and the Municipal Administrator to attend the Tiger Hills Conservation District 3rd Annual General Meeting to be held in Glenboro, Manitoba on Thursday February 26th, 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress participate in the investigation of the environmental, operational and financial feasibility of the use of an air curtain burner in the disposal of dead stock, the appropriateness of establishing and operating of a regional waste management authority to utilize the air curtain burner and commit a grant of $1,000.00 to be utilized in the research program and investigation.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize all Council members to attend the Association of Manitoba Municipalities’ meeting regarding dead livestock rendering, which is to be held in Brandon, Manitoba on Wednesday March 3, 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress lobby the Federal and Provincial Governments to allow for the dispensing of dyed gasoline directly into farm trucks at card lock facilities in the Province of Manitoba.

RESOLVED that the Council of the Rural Municipality of South Cypress award a grant in the amount of $100.00 to Chantal Fillion of Glenboro, Manitoba to assist in offsetting her costs in attending the Forum for Young Canadians, which is to be held in Ottawa on March 6 – 13, 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize any member of Council and the Municipal Administrator to attend a one-day Seminar on Municipal Weed Control Issues, being hosted by Manitoba Agriculture and the Manitoba Weed Supervisors Association, which is to be held in Holland, Manitoba on Wednesday, March 24, 2004.

WHEREAS as provided for in Section 365(2) of the Municipal Act, a Council may in any year designate the immediately preceding year or any earlier year as the year for which properties the taxes in respect of which are in arrears for the year must be offered for sale by auction to recover the tax arrears and costs;

NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress, designate Tax Year 2003 as the year for which properties the taxes in respect of which are in arrears (2002 Taxes) must be fully paid prior to commencement of the 2004 Municipal Tax Sale and failing payment of all 2002 tax arrears the respective property will be offered for sale by auction in order to recover the tax arrears and costs;

AND FURTHER BE IT RESOLVED that the Rural Municipality of South Cypress conduct this year’s Tax Sale at a suitable date & time, in the fall of the year 2004, as determined by the Chief Administrative Officer.

RESOLVED that the Council of the Rural Municipality of South Cypress hold a special meeting on Tuesday April 6, 2004 at 10:00 a.m. to set and adopt the Municipality’s Budgeted Operating Expenditures for fiscal year 2004.

AND FURTHER BE IT RESOLVED that in compliance with Section 162(2) of The Municipal Act, the Council of the Rural Municipality of South Cypress hold a Public Hearing on Tuesday, April 13, 2004 at 1:30 p.m. in the R. M. of South Cypress Council Chambers at Glenboro, Manitoba for the purpose of presenting its Financial Plan for fiscal year 2004 and subsequently giving any person who wishes, opportunity to make representation, ask questions or register an objection to the Financial Plan so presented.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize Municipal Administrator, Eric Plaetinck, to attend the M.M.A.A. seminar concerning the Federal Goods & Service Tax, Municipal Finance and Budgeting, which is to be held in Brandon, Manitoba on Wednesday February 25, 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress do now adjourn @ 4:10 p.m., to convene again at the next regular meeting scheduled for Tuesday, March 9, 2004, at 9:00 a.m.
