Minutes of the eleventh regular meeting of the 2003/2004 Council of the Rural Municipality of South Cypress held in the Municipal Council chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, September 14, 2004 at 8:00 a.m.

Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen, and Chief Administrative Officer, Eric Plaetinck.

Reeve Earl E. Malyon, in the chair, called the meeting to order at 8:00 a.m.

During the meeting, at the time indicated, Council held the noted public hearings and met with the following delegations.

RESOLVED that the minutes of the last regular meeting of Council held on Tuesday August 10, 2004 be taken as read and approved, all statutory requirements having been fulfilled.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2004 accounts from cheque #2130 to and including cheque #2175, as submitted to Council by the Municipal Administrator.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the rental of a used Valmet 4WD (170 hp) tractor from H & L Motors Ltd. of Glenboro, Manitoba, for approximately 200 hours of use during the 2004 Municipal grass mowing season.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize all Council Members and Equipment Operators to attend the Grand Opening/Open House of the Peterbilt Manitoba Ltd. facility in Winnipeg, Manitoba on Thursday September 16th, 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize all Council Members and Equipment Operators to attend the Grand Opening of the Toromont Caterpillar facility in Winnipeg, Manitoba on Thursday September 16th, 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress agree to the following adjusted percentages for the purpose of calculating the funding, under the Manitoba Product Stewardship Program, for the regional recyclable materials collected at the Village of Glenboro and the Glenboro-South Cypress Wastes Transfer Station:

Village of Glenboro - 656 Population (44%) - adjusted to 100%

R. M. of South Cypress - 821 Population (56%) - adjusted to 0%

RESOLVED that the Council of the Rural Municipality of South Cypress contract the services of Zenith Paving Ltd. of Brandon, Manitoba to crush and stockpile 20,000 cubic yards of road gravel at the Craig Bell gravel pit (SW Ό 10-8-16W) for the quoted/agreed to price of $2.10 plus G.S.T. per cubic yard;

AND FURTHER RESOLVED that the crushing of the said 20,000 cubic yards of gravel be undertaken this fall, or as soon as possible thereafter, at the contractors choice/convenience, and accordingly billing and payment of same be deferred to July 1, 2005.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of $1,262.60 to the land surveying firm of Prairie Benchmark Land Surveys of Brandon, Manitoba, for services rendered in the complete restoration of three missing survey outline monuments at the North Ό of Section 28; Township 7; Range 16 W1, the East Ό of Section 29; Township 7; Range 16 W1 and the North Ό of Section 21; Township 7; Range 16 W1;

AND FURTHER BE IT RESOLVED that the Municipality make application to the Provincial Property Registry for reimbursement of 50% of the said restoration costs, under the "Survey Outline Monument Restoration Program".

At a Public Hearing held at 11:30 a.m., in regard to Conditional Use application #CU11-04-SC; Variation Order application #V6-04-SC and Variation Order application #V7-04-SC, representation was made by the applicant Leonard Plett.

R. M. OF SOUTH CYPRESS UNDER THE PLANNING ACT

CONDITIONAL USE ORDER NO. CU11-04-SC

WHEREAS Leonard & Luella Plett the owners of the property legally described as Pt. of the N ½ Sec. 28-7-16 WPM and located at approx. 2 miles southeast of Treesbank in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress for approval of a Conditional Use order under Zoning By-law #1485 Part IV, Section 6, Table IV-I, in order to:

Allow the establishment of a Rural Non-Farm dwelling site in the "A80" agricultural district. [18 acres as proposed Lot #2 in surveyors sketch]

And after careful consideration of the application and any representations made for or against it, the Council of the R. M. of South Cypress in a meeting duly assembled on the 14th day of September A.D., 2004

Approved the said application.

Approval shall expire if not acted upon within 12 months of the date of making.

VARIATION ORDER BY THE R. M. OF SOUTH CYPRESS

VARIATION ORDER NO: V6-04-SC

WHEREAS Leonard & Luella Plett owners of the property legally described as Pt. of the N ½ Sec. 28-7-16 WPM and located at approx. 2 miles southeast of Treesbank in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress to vary the application of Part IV, Section 8, zoning By-law #1485 provided under clause (A) of Subsection (3) of Section 57 of the Planning Act as it applies to the property, in order to vary the established requirements, in accordance with the appended sketch as follows:

From: A minimum site area of: 80 acres

To: A minimum site area of: 40 acres

For the purpose of: Allowing the creation of a 40 acre agricultural parcel.

And after careful consideration of the application and any representations made for or against the variation sought by the applicant, Leonard Plett,

The Council of the R. M. of South Cypress in meeting duly assembled on the 14th day of September A.D., 2004

Approved the said application.

Approval shall expire if not acted upon within 12 months of the date of making.

VARIATION ORDER NO: V7-04-SC

WHEREAS Leonard & Luella Plett owners of the property legally described as Pt. of the N ½ sec. 28-7-16 WPM and located at approx. 2 miles southeast of Treesbank in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress to vary the application of Part IV, Section 8, zoning By-law #1485 provided under clause (A) of Subsection (3) of Section 57 of the Planning Act as it applies to the property, in order to vary the established requirements, in accordance with the appended sketch as follows:

From: A minimum site width of: 300 feet

To: A minimum site width of: 165 feet

For the purpose of: Allowing a reduction in the site frontage for a specialized agricultural parcel – storage buildings (proposed Lot 1 in Pt N ½ 28-7-16 WPM surveyors sketch)

And after careful consideration of the application and any representations made for or against the variation sought by the applicant, Leonard Plett,

The Council of the R. M. of South Cypress in meeting duly assembled on the 14th day of September A.D., 2004

Approved the said application.

Approval shall expire if not acted upon within 12 months of the date of making.

RESOLVED that the plan of Subdivision of Land described as follows;

Being part of the S.E. Ό of Section 1, Township 8, Range 16W1, as shown on a drawing and being attached to an application for subdivision file #14-4187-04-4056 and being submitted by John F. Fraser;

Be hereby approved by the Council of the Rural Municipality of South Cypress.

Approval is given subject to the following conditions:

That a conditional use order be obtained to permit the non-farm dwelling site within the "A80" Zone.

That a variation order for the site width of the proposed parcel be obtained.

3. That the width of the access lane be increased to 66’.

RESOLVED that the plan of Subdivision of Land described as follows;

Being part of the S ½ of Section 8, Township 7, Range 14W1, as shown on a drawing and being attached to an application for subdivision file #14-4187-04-4061 and being submitted by Janice Hird;

be hereby approved by the Council of the Rural Municipality of South Cypress.

Approval is given subject to the following conditions;

That a conditional use order be obtained to permit the non-farm dwelling site within the "A80" Zone.

2. That the surveyor verifies that the location of any buildings in close proximity to the new property lines conforms to the set-back requirements of the zoning By-law and if any do not conform, appropriate variation orders are approved.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize all Council Members to attend a special meeting of the A.M.M. Western District to be held in Pipestone, Manitoba on Wednesday September 22nd, 2004 for the purpose of discussing the resolution(s) seeking the removal of Education Taxes from farm land and/or all properties.

RESOLVED that the Council of the Rural Municipality of South Cypress renew its support of the Southwest Regional Round Table and the continued participation of Economic Development Officer, Darren Myers as Municipal Representative on the said committee.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize a "one-time" grant of up to $ 500.00 to the Shilo Area Military Relations Committee "Brandon Salutes", which is to assist in providing welcoming activities addressed at the 2PPCLI and/or other military in general.

RESOLVED that the Council of the Rural Municipality of South Cypress endorse the Glenboro Community Development Committee’s actions in proceeding with the Glenboro Museum project involving the Glenboro Area History Book Addendum and the subsequent commitment of ordering the printing of a total 1500 of the said history books.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize all Council Members to attend a National Livestock Conference entitled "Living with Livestock: Environment & Change", which is to be held in Winnipeg, Manitoba on October 5th – 7th, 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize Councillor John S. Hamilton to attend the 25th Annual Provincial Recreation Conference for Community Volunteers, which will be held in Brandon, Manitoba on November 5th – 7th, 2004.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize Municipal Administrator, Eric Plaetinck, to attend the Manitoba Municipal Administrators Association District 2 Meeting, which is to be held at Killarney, Manitoba on Friday, October 1, 2004.
