Minutes of the fourth regular meeting of the 2004/2005 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Avenue, Glenboro, Manitoba on Tuesday, February 8, 2005 at 9:00 a.m.

Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck.

Reeve Earl E. Malyon, presiding, called the meeting to order at 9:05 a.m.

RESOLVED that the Council of the Rural Municipality of South Cypress adopt the Municipality’s Financial Statement for Fiscal Year ending December 31, 2004, as presented by the Chief Administrative Officer, showing a Net Operating Surplus of $7,144.83.

RESOLVED that the Council of the Rural Municipality of South Cypress purchase a new 2005 Caterpillar 928G Wheel Loader Serial # DJD01688 c/w a 7 year/5000 hour extended power train & hydraulics warranty, from Toromont Cat of Brandon, Manitoba, with the trade-in of a used 1991 John Deere 544E Wheel Loader Serial # DW544E B533518, as per further details specified in the respective February 8, 2005 sales order.

WHEREAS the Council of the Rural Municipality of South Cypress on December 14, 2004, duly appointed Mr. Paul Wilton of Glenboro, Manitoba as a "Permanent Seasonal" Municipal Grader Operator,

NOW THEREFORE BE IT RESOLVED that Mr. Wilton commence his employment for the 2005 season at the call of the Council with a 50 hour work week and as per further terms and conditions to be specified in his 2005 employment agreement;

RESOLVED that the Council of the R. M. of South Cypress authorize Equipment Operators; Ed Berry, Allan Bartram and Paul Wilton to attend the Manitoba Good Roads Association Seminar entitled "Drainage for Municipalities" being held on Monday February 28, 2005 in Brandon.

RESOLVED that the Council of the Rural Municipality of South Cypress adopt the street address numbers assigned to the houses/lots located in the Hamlet of Treesbank, as shown on a plan attached/marked as Schedule T.

WHEREAS a Transport Canada Inspector has, in a January 31, 2005 report, condemned the further use of the Municipality’s diesel fuel slip tank currently carried in the Municipal pickup truck;

NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress authorize the purchase of a new 100-gallon diesel fuel slip tank from a supplier with the most favourable price.

RESOLVED that the year 2005 spring road restrictions, for designated municipal roads within the limits of the R. M. of South Cypress, will commence on or after March 15, 2005; (actual implementation date dependent on weather conditions) and shall remain in effect for a period of six to eight weeks.

The following specified municipal roads, lying within the Rural Municipality of South Cypress, which is classified as a "B Highway", shall be weight restricted, when so posted, to 65% of normal axle loads;

1 mile of Public road lying within Section 3; Township 7; Range 14 WPM, referred to as the I.P.L Road, and

3 miles of Public Road lying directly North of Sections 25 & 26; Township 7; Range 14 WPM and directly North of Section 30; Township 7; Range 13 WPM.

With the exception of the above noted roads, all other municipal roads, within the limits of the Rural Municipality of South Cypress will not be subject to spring weight restrictions.

RESOLVED that the Council of the Rural Municipality of South Cypress apply to Manitoba Transportation and Government Services for a year 2005 grant of up to $1,148.40 for improvements to a selected portion of Provincial Road #530, North of P.T.H. #2 to Treesbank, consisting of building up the road base with shale.

RESOLVED that the Council of the Rural Municipality of South Cypress re-appoint Westoba Credit Union Ltd., Glenboro Branch, to provide all necessary banking services required by the Municipality during the term June 1, 2005 to May 31, 2008, as per same terms and conditions specified in the current contract.

WHEREAS the Swan Lake First Nation has requested the Province of Manitoba to close and transfer to them, certain undeveloped Government Road Allowances, In Township 9; Range 14W1, lying adjacent to properties they currently own;

NOW THEREFORE BE IT RESOLVED that the Council of The Rural Municipality of South Cypress consent to the closing and transferring of only those undeveloped Government Road Allowances between the NW ¼ of Section 9 & the SW ¼ of Section 16, and the SW ¼ of Section 17 & the SE ¼ of Section 18 and LS 12 of the NW ¼ of Section 17 & LS 9 of the NE ¼ of Section 18; all in Township 9; Range 14 WPM, with the condition, that a fair consideration, acceptable to Council, be made to the Rural Municipality of South Cypress for the approximately 15 acres being so closed and transferred.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of $1,415.00 to the Glenboro Community Development Corporation, to assist in the retirement of the $2,830.00 deficit remaining on the Glenboro-South Cypress Area Wireless High-Speed Internet Project.

RESOLVED that the Council of the Rural Municipality of South Cypress acknowledge the 2004 Financial Statement of the Cypress River Memorial Hall Committee and accept a year 2005 operating levy requirement of $1,163.00 for the R. M. of South Cypress.

RESOLVED that the Council of the Rural Municipality of South Cypress approve a 2005/2006 amendment extension agreement between the Government of Manitoba, the Village of Glenboro, The Rural Municipality of South Cypress, The Rural Municipality of Argyle and the Rural Municipality of Strathcona for the continued operation of the Spruce Lakes Recreation District.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize any member of Council and the Municipal Administrator to attend a one-day seminar on Municipal Weed Control Issues, being hosted by Manitoba Agriculture and the Manitoba Weed Supervisors Association, which is to be held in Holland, Manitoba on Wednesday, March 23, 2005.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize all members of Council to attend a Public Meeting, regarding the feasibility of establishing a cattle slaughter facility in the Neepawa District, which is to be held in Neepawa, Manitoba on Thursday February 17, 2005.

WHEREAS it is recognized by all levels of government within Canada that Canada presently lacks sufficient capacity to slaughter and process the cattle produced in Canada;

AND WHEREAS all levels of government within Canada, as well as Canadian Beef Producers and Consumers, recognize that it is not in the economic interests of Canada for the Canadian economy in general, and the Canadian beef industry in particular, to rely upon foreign-located packers to slaughter and/or process Canadian-bred cattle;

AND WHEREAS, various levels of government within Canada have expended in excess of three billion dollars in order as to assist the Canadian cattle industry to overcome the adverse effects of BSE crisis;

AND WHEREAS, despite such unprecedented levels of financial support, no new Canadian-owned high-volume cattle slaughter facilities have been constructed in Canada since the BSE crisis commenced;

AND WHEREAS the BSE crisis has had a devastating economic and social impact upon communities throughout Manitoba and Canada;

AND WHEREAS, as a result of the adverse effects of the BSE crisis, Canadian cattle producers presently lack the financial resources to construct a high-volume beef slaughter facility in Canada;

AND WHEREAS the Grass Root Producers has proposed a producer-owned beef slaughter facility to be located in Manitoba;

AND WHEREAS the province of Manitoba does not presently possess sufficient beef slaughter capacity to meet the demands of Manitoba consumers, let alone the demands of the Manitoba beef cattle industry;

NOW THEREFORE BE IT RESOLVED that The Rural Municipality of South Cypress hereby supports the Grass Root Producers in their efforts to have a producer-owned high-volume beef slaughter and processing facility in Manitoba and urges the Government of Canada to provide appropriate levels of financial assistance, in such form and manner as shall be necessary in order to accomplish the construction of such a facility.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the Chief Administrative Officer, in accordance with Regulation #53/97 of the Municipal act, to destroy forthwith, in an appropriate fashion, all such out-dated and obsolete Municipal records & documents as specified in the listing attached hereto and marked as "Schedule A"

WHEREAS as provided for in Section 365(2) of the Municipal Act, a Council may in any year designate the immediately preceding year or any earlier year as the year for which properties the taxes in respect of which are in arrears for the year must be offered for sale by auction to recover the tax arrears and costs;

NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress, designate Tax Year 2004 as the year for which properties the taxes in respect of which are in arrears (2003 Taxes) must be fully paid prior to commencement of the 2005 Municipal Tax Sale and failing payment of all 2003 tax arrears the respective property will be offered for sale by auction in order to recover the tax arrears and costs;

AND FURTHER BE IT RESOLVED that the Rural Municipality of South Cypress conduct this year’s Tax Sale at a suitable date & time, in the fall of the year 2005, as determined by the Chief Administrative Officer.

WHEREAS Manitoba Intergovernmental Affairs and Trade has advised Council that all properties in the Rural Municipality of South Cypress will be reassessed for the 2006 tax year;

AND WHEREAS the District Assessment Office Supervisor will inform Council at a meeting scheduled for Tuesday April 12, 2005, the impact that the said reassessment will have upon properties and subsequently the Municipality;

AND WHEREAS Tuesday May 31, 2005, from 1:00 p.m. to 4:00 p.m. has been scheduled for the public’s opportunity to "Meet the Assessor";

NOW THEREFORE BE IT RESOLVED that the Council of The Rural Municipality of South Cypress conduct the "2006 Board of Revision" on Tuesday October 18, 2005 at 10:00 a.m.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize Reeve Earl E. Malyon, Deputy Reeve John S. Hamilton and CAO Eric Plaetinck to attend the A.M.M. Central District 2005 Mayors & Reeves meeting which is to be held in Treherne, Manitoba on March 15, 2005.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize Municipal Administrator, Eric Plaetinck, to attend a M.M.A.A. seminar presented by the Manitoba Emergency Measures Organization, concerning disaster financial assistance, which is to be held in Brandon, Manitoba on Wednesday, March 2, 2005.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize the Chief Administrative Officer to purchase order 500 Municipal seal lapel pins from Brian Shippam Inc. of Winnipeg, Manitoba at a cost of up to $1.90 per pin;

AND FURTHER BE IT RESOLVED that the Council of The Rural Municipality of South Cypress authorize the Chief Administrative Officer to purchase order 250 Municipal imprinted pens from Amsterdam Products of Cornwall, Ontario at a cost of $2.29 per pen.

RESOLVED that the Council of the Rural Municipality of South Cypress hold a special meeting on Tuesday April 5, 2005 at 10:00 a.m. to set and adopt the Municipality’s Budgeted Operating Expenditures for fiscal year 2005.

AND FURTHER BE IT RESOLVED that in compliance with Section 162(2) of The Municipal Act, the Council of the Rural Municipality of South Cypress hold a Public Hearing on Tuesday, April 12, 2005 at 1:30 p.m. in the R. M. of South Cypress Council Chambers at Glenboro, Manitoba for the purpose of presenting its Financial Plan for fiscal year 2005 and subsequently giving any person who wishes, opportunity to make representation, ask questions or register an objection to the Financial Plan so presented.
