Minutes of the third regular meeting of the 2004/2005 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Avenue, Glenboro, Manitoba on Tuesday, January 11, 2005 at 9:00 a.m. Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, W. Jack Mooney, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, presiding, called the meeting to order at 9:10 a.m. During the meeting, at the time indicated, Council held the noted public hearing and met with the following delegations. #7209 J. S. Hamilton – L. J. Berry RESOLVED that the minutes of the last regular meeting of Council held on Tuesday December 14, 2004 be taken as read and approved, all statutory requirements having been fulfilled. "carried"
#7210 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2004 accounts from cheque #2369 to and including cheque #2410, as submitted to Council by the Municipal Administrator. "carried"
#7211 W. R. Cullen – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2005 accounts from cheque #2500 to and including cheque #2507, as submitted to Council by the Municipal Administrator. "carried"
#7212 L. E. Coates – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1786, (Re: Borrowing and/or Overdraft Authorization @ Westoba Credit Union Ltd.), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. "carried"
#7213 W. R. Cullen – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1787 (Re: Appointment of 2005 Chief Administrative Officer), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. "carried"
#7214 L. E. Coates – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress adopt the rental rates and conditions for the year 2005, for specified Municipal labour, equipment and materials as set out in Schedule "A", attached hereto and forming part of this resolution. "carried"
#7215 W. J. Mooney – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress enter into a right of way agreement with Snowmobilers of Manitoba Inc. and Tri-Lake Trail Busters for their "right of use" of certain Municipal Road Ditches and Road Allowances lying within the Municipality, which they propose to access/traverse during the 2004/2005 Winter Snowmobiling Season. "carried"
#7216 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress accept the recommendation of Mr. Ken G. James of the insurance adjusting firm of James Dube Spraggs in the claim sought by Manitoba Telephone System for the October 3, 2003 damages sustained to their communication cable located in the Assiniboine riverbed under the pathway of the Stockton Ferry. "carried"
#7217 L. E. Coates – J. S. Hamilton RESOLVED that the Council of the Rural Municipality of South Cypress accept the resignation of Connie Sveinson as Municipal representative on the Board of the Glenboro Community Foundation Fund effective January 11, 2005; AND FURTHER BE IT RESOLVED that the Council of the Rural Municipality of South Cypress appoint Municipal Resident Ratepayer Lorelie Mitchell to the Board of the Glenboro Community Foundation Fund for the term January 11, 2005 to November 14, 2006. "carried"
At a Public Hearing held at 11:30 a.m., in regard to Conditional Use application #CU16-04-SC, no representation was received by Council.
#7218 W. J. Mooney – W. R. Cullen UNDER THE PLANNING ACT CONDITIONAL USE ORDER NO. CU 16-04-SC Whereas Arlene & Raymond Spencer, the owners of the property legally described as Pt. of the NW 1/4 SEC. 7-7-16 WPM and located at approx. 15 miles West of Glenboro in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress for approval of a Conditional Use Order under Zoning By-Law No. 1485 Part IV, Section 6, Table IV-I, in order to: ALLOW THE ESTABLISHMENT OF A RURAL NON-FARM DWELLING SITE IN THE "A-80" AGRICULTURAL DISTRICT. [APPROX.4 ACRES] and after careful consideration of the application and any representations made for or against it, the Council of the R. M. of South Cypress in a meeting duly assembled on the 11th day of January A.D, 2005, APPROVED the said application. Approval is given subject to the following conditions: Approval shall expire if not acted upon within 12 months of the date of making. "carried"
#7219 L. E. Coates – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize all members of Council, to attend the 2005 Manitoba Planning Conference being held in Brandon, Manitoba on February 9 - 11, 2005. "carried"
#7220 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize Municipal Equipment Operators Edwin Berry, Allan Bartram and Paul Wilton to attend the Association of Manitoba Municipalities Trade Show, which is being held in Brandon, Manitoba on Monday, February 28, 2005. "carried"
#7221 L. E. Coates – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress grant the Tiger Hills Arts Association office space within the Municipal Office Building during the period September 1, 2005 to September 1, 2006; AND FURTHER BE IT RESOLVED that the Council of the Rural Municipality of South Cypress value this gift-in-kind at $1,200.00. "carried" #7222 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of $2,380.00 to the Glenboro Gaiety Theatre representing the full requirement of the Municipality’s 2005 tax levy for the Theatre. "carried"
#7223 J. S. Hamilton – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of $4,219.22 to the Glenboro Veterinary District Board, representing approximately 50% of the anticipated requirement for the Municipality’s 2005 tax levy for the Veterinary District. "carried"

Cullen RESOLVED that the Rural Municipality of South Cypress renew its membership with the following organizations and thereby authorizes payment of the respective 2005 membership fee: Association of Manitoba Municipalities Manitoba Municipal Administrators Association Glenboro Community Development Corporation Manitoba Good Roads Association USTI Auto-Administrator User Group Hudson Bay Route Association Burrough of The Gleann Museum "carried"
#7225 W. J. Mooney – J. S. Hamilton RESOLVED that the Council of the Rural Municipality of South authorize all members of Council to attend a Public Meeting, regarding the feasibility of establishing a cattle slaughter facility in the Neepawa District, which is to be held in Neepawa, Manitoba on Wednesday January 12, 2005. "carried"
#7226 L. E. Coates – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress set the following rates for photocopying with the Municipal office’s Kyocera photocopier during the year 2005: Ratepayers - $ 0.15 cents per copy Clubs/Organizations - $ 0.15 cents per copy Non-Ratepayers - $ 0.25 cents per copy AND FURTHER BE IT RESOLVED that the Council of the Rural Municipality of South Cypress set the rate of $0.50 per page for each page faxed, to a Canadian or American Destination with the Municipality’s fax machine during the year 2005. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress authorize the sale of its Municipal land ownership maps at the following rates during the year 2005: 1"/Mile Coloured - $ 20.00 per map (includes all taxes) 1"/Mile Black & White - $ 14.00 per map (includes all taxes) "carried"

Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize Administrative Clerk, Maureena McPhail to attend a MMAA/UM seminar entitled "Issues in Development and Land Use Control Law", which is to be held in Brandon on Friday March 11, 2005. "carried"
#7229 L. E. Coates – W. J. Mooney RESOLVED that the Council of the Rural Municipality of South Cypress authorize all members of Council, to attend the Association of Manitoba Municipalities’ Educational Seminar, entitled "Decision Making for Councils and Boards", which is being held in Portage La Prairie, Manitoba on Friday, March 18th, 2005. "carried"
#7230 L. E. Coates – W. R. Cullen RESOLVED that the Rural Municipality of South Cypress jointly with the Village of Glenboro host the Association of Manitoba Municipalities Western District Summer Meeting which is to be held in the Glenboro Kinsmen Community Hall on Thursday June 23, 2005. "carried"
#7231 J. S. Hamilton – L. E. Coates RESOLVED that the Council of the Rural Municipality of South Cypress authorize all members of Council and the Chief Administrative Officer to attend the Association of Manitoba Municipalities Municipal Officials Seminar being held in Brandon, Manitoba on February 28 & March 1, 2005. "carried"
#7232 W. J. Mooney – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress do now adjourn @ 2:50 p.m., to convene again at the next regular meeting scheduled for Tuesday, February 8, 2005 at 9:00 a.m. "carried" |
