Minutes of the tenth regular meeting of the 2006/2007 Council of the Rural Municipality of South Cypress held in the Municipal/Village Council Chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, August 14th, 2007 at 8:30 a.m.

 Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Leonard K. Plett, Walter R. Cullen and Chief Administrative Officer Eric Plaetinck.

 Reeve Earl E. Malyon presiding, called the meeting to order @ 8:30 a.m.

 During the meeting, at the time indicated, Council met with the following delegations and conducted the noted public hearing:

RESOLVED that the minutes of the last regular meeting of Council held on Tuesday July 10, 2007 be taken as read and approved, all statutory requirements having been fulfilled.

 RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2007 accounts from cheque #4349 to and including cheque #4393, as submitted to Council by the Municipal Administrator.

 RESOLVED that the Council of the Rural Municipality of South Cypress jointly with the Council of the Rural Municipality of Strathcona authorize the removal of the deteriorated steel culvert on the inter-municipal road located at the SE of section 6-7-15W and the NW of section 31-6-15W; and the installation, in the fall of 2007, at its same exact site a new 2.0 mm x 1800 mm x 10.67 metre galvanized culvert;

AND FURTHER BE IT RESOLVED that the said new 2.0 mm x 1800 mm x 10.67 metre galvanized culvert be purchased from Armtec Limited of Winnipeg, Manitoba at a cost of up to $9,400.00 plus applicable taxes FOB site.

 AND FURTHER BE IT RESOLVED that the net cost of the culvert, all materials and installation charges incurred be shared equally between both Municipalities.

Resolved that the Council of the Rural Municipality of South Cypress adopt the following Pipeline Crossing Policy with respect to Enbridge’s  “Alberta Clipper & Southern Lights” oil pipeline expansions:

All road allowances are deemed to be 99 feet in width.

 All pipelines must be installed between 45 and 90-degree angles to the road allowance and on developed roads.

 Pipelines must cross road allowances at the low spots where possible.

The minimum pipeline depth through all road crossings shall be 2.15 metres. The depth of road crossings shall be maintained throughout the entire width of the road allowance a minimum of 15.3 metres on each side of the road allowance.

 All developed roads must be punched/bored through from shoulder to shoulder. The minimum pipeline depth shall be 2.15 metres below the ditch and 2.65 metres below the road surface. 

When the work is complete, the road allowance shall be restored by the owner of the pipeline to its original or better condition, including, within a year of completion, the re-vegetation establishment where the ground has been disturbed.

 Plans of completed pipeline crossing must be provided to the Municipality for use in future roadwork.

 The owner/applicant/developer and/or their successor shall now and in the future indemnify and save harmless the Rural Municipality of South Cypress its agents, employees or any person legally empowered by the Municipality from any and all liabilities, environmental damages, costs, claims, suits or actions arising out or the approval hereby granted, to the extent that the said liabilities, environmental damages, costs, claims, suits or actions are not the result of the Rural Municipality of South Cypress its agents or employees negligence or wilful misconduct. 

If future roadwork is required at any of the crossing sites it is understood and agreed that the pipeline will be lowered at no cost to the Municipality, all such costs will be borne by the owner.

 All pipeline markers on any road allowance must be 40 feet apart to freely allow travel by large equipment.

 No road closures will be allowed without the prior permission of the Council of the Rural Municipality of South Cypress. Daily fines of $250.00 will be charged if there are any infractions regarding road allowances.

RESOLVED that the Council of the Rural Municipality of South Cypress support the sale of 16 acres of Agricultural Crown Land, lying in legal subdivision 11, in the NW ¼ of Section 3; Township 8; Range 14 WPM, to the adjoining landowner.

RESOLVED that the Council of the Rural Municipality of South Cypress adopt and approve the Municipality’s updated Emergency Plan, which is shown in conjunction with the Spruce Lakes Emergency Measures Plan, being submitted by Emergency Measures Co-ordinator, Garth McIntyre.

RESOLVED that the Council of the Rural Municipality of South Cypress acknowledge and accept the terms, conditions and rates specified by the Municipal auditing firm of BDO Dunwoody LLP, of Winnipeg, Manitoba as outlined in a July 24, 2007 letter, which explains CICA revised auditing standards and guidelines which affects the scope and nature of the auditing procedures for the Municipality.

At a Public Hearing held at 11:00 a.m., in regard to Conditional Use Application #CU10-07-SC, the only representation which was made was by the applicant, Dennis Friesen.

UNDER THE PLANNING ACT

 CONDITIONAL USE ORDER NO: CU10-07-SC  

Whereas Dennis Friesen (Applicant) for Dale and Karen Naismith, the owners of the property legally described as PT. OF THE NE¼ SEC. 3-8-16WPM and located at approximately 1/2 mile north of Millford Cemetery in the R. M. of South Cypress, applied to the Council of the R. M. of South Cypress for approval of a Conditional Use Order under Zoning By-Law NO.1485 PART IV, SECTION 6, TABLE IV-I, in order to:

 Allow the creation of a rural non-farm dwelling (19 acres) in the "A80" agricultural district,   

And after careful consideration of the application and any representations made for or against it, 

The Council of the R. M. of South Cypress in a meeting duly assembled on the 14th day of August AD., 2007.

 APPROVED  the said application.

 Approval is given subject to the following conditions:

 That all existing livestock structures located on the proposed lot be removed at such time as determined by Council

Approval shall expire if not acted upon within 12 months of the date of making.

 RESOLVED that the Council of the Rural Municipality of South Cypress acquire up to 5,000 cubic yards of shale from the Rudy Kovar shale pit located at the SE 21-6-14 WPM, (Said shale is to be dug out and stockpiled at Municipal expense).

RESOLVED that the Council of the Rural Municipality of South Cypress accept an “offer to buy” submitted by Mr. Jeff Boles of Glenboro, Manitoba for the purchase of 2 sections of used culverts 30” x 8’ each (total length 16 ft.).

 RESOLVED that the Council of the Rural Municipality of South Cypress award a grant in the amount of $200.00 to the Glenboro School to support Glenboro School student’s, who are participating in the 2007/2008 “Encounters with Canada” program, with respective travel and lodging costs associated with their journey to Ottawa, Ontario.

 RESOLVED that the plan of Subdivision of Land described as follows;

Being part of the SW ¼ of Section 18, Township 8, Range 16W1, as shown on a drawing and being attached to an application for subdivision file #14-4187-07-4325 and being submitted by Mr. Brian Jackson on behalf of the registered owner, Shelly Anderson;
be hereby approved by the Council of the Rural Municipality of South Cypress.

 Approval is given subject to the following condition:

That a conditional use order be obtained to permit the non-farm single-family dwelling site within the “A80” Zone.

 WHEREAS “Agriculture in the Classroom-Manitoba Inc.” is a non-profit organization dedicated to delivering curriculum-based programs to Manitoba Schools to help teach the importance of agriculture in our Province.

 NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress support “Agriculture in the Classroom-Manitoba Inc.” by renewing its membership with the said organization at the supporter level of $150.00 for the year 2007.

RESOLVED that the Council of the Rural Municipality of South Cypress do now adjourn @ 11:50 a.m., to convene again at the next regular meeting scheduled for Tuesday, September 11th, 2007 at 8:30 a.m.
