Minutes of the fourth regular meeting of the 2006/2007 Council of the Rural Municipality of South Cypress held in the Municipal/Village Council Chambers at 618 Railway Avenue, Glenboro, Manitoba, on Tuesday, February 13th, 2007 at 9:00 a.m. Present at the Meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, Leonard K. Plett, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, presiding, called the meeting to order at 9:00 a.m. During the meeting, at the time indicated, Council met with the following delegations: Sgt. Bob Chabot } R.C.M.P. #7693 L. E. Coates – L. K. Plett RESOLVED that the minutes of the last regular meeting of Council held on Tuesday January 13th, 2007 be taken as read and approved, all statutory requirements having been fulfilled. "carried"
#7694 L. J. Berry – J. S. Hamilton RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2006 accounts from cheque #3980 to and including cheque #3983, as submitted to Council by the Municipal Administrator. "carried"
#7695 L. J. Berry – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress adopt the Municipality’s Financial Statement for fiscal year ending December 31, 2006 as presented by the Chief Administrative Officer showing a net operating surplus of $19,326.62. "carried"
#7696 L. E. Coates – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2007 accounts from cheque #4009 to and including cheque #4025 as submitted to Council by the Administrator. "carried"
#7697 W. R. Cullen – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1807, (Vis-à-vis the appointment of Eric C. Plaetinck as the 2007 Chief Administrative Officer), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. "carried"
#7698 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize full payment to Toromont Cat of Brandon, Manitoba for a new 2007 Caterpillar 160H Motor Grader serial #ASD00750, as per particulars specified in the December 13, 2006 sales agreement. AND FURTHER BE IT RESOLVED that the required funds, net of GST, required in the said purchase be transferred out of the Machinery Replacement Reserve, Account #8816019, for fiscal year 2007. "carried"
#7699 L. E. Coates – L. K. Plett RESOLVED that the Council of the Rural Municipality of South Cypress contract the services of Dave’s Do It Right Construction of Cypress River, Manitoba to supply all required labour and materials in the installation of metal to approximately 2,300 square feet of interior walls and ceiling in the north end of the Municipal equipment shed. "carried"
#7700 L. K. Plett – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress authorize Equipment Operators Ed Berry, Al Bartram and Paul Wilton to attend the Manitoba Good Roads Association Seminar entitled "Bridge Replacement Issues" being held on Monday February 26, 2007 in Brandon. "carried"
#7701 J. S. Hamilton – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress grant $400.00 to the Glenboro Agricultural Society to aid in the staging of their annual fair, to be held on June 30 and July 1, 2007. "carried"
#7702 L. K. Plett – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress apply to Manitoba Transportation and Government Services for a year 2007 grant of up to $1,276.80 for improvements to a designated portion of Provincial Road #530, North of P.T.H. #2 to the Hamlet of Treesbank. "carried"
#7703 J. S. Hamilton – L. J. Berry RESOLVED that the year 2007 spring road restrictions for designated municipal roads within the limits of the R.M. of South Cypress, will commence on or after March 15, 2007; (actual implementation date dependent on weather conditions) and shall remain in effect for a period of up to 10 weeks, as determined by Council; The following specified municipal roads, lying within the Rural Municipality of South Cypress, which are classified as a "B Highway", shall be weight restricted, when so posted, to 65% of normal axle loads; 1 mile of Public Road lying within Section 3; Township 7; Range 14WPM, referred to as the I.P.L. Road, and; 3 miles of Public Road lying directly north of Sections 25 and 26; Township 7; Range 14WPM and directly north of Section 30; Township 7; Range 13 WPM, and; 7 miles of Public Road #78W from P.T.H. #2 to Municipal Road #45N With the exception of the above noted roads, all other municipal roads, within the limits of the Rural Municipality of South Cypress will not be subject to spring weight restrictions. "carried"
#7704 L. E. Coates – W. R. Cullen WHEREAS the Council of the Rural Municipality of South Cypress has duly appointed Mr. Paul Wilton of Glenboro, Manitoba, as a Seasonal Municipal Grader Operator; NOW THEREFORE BE IT ESOLVED that the Council of the Rural Municipality of South Cypress authorize Mr. Wilton to commence his employment for the 2007 season at the call of the Council, with a 50 hour work week and as per further terms and conditions to be specified in his 2007 employment agreement. "carried"
#7705 L. K. Plett – W. R. Cullen WHEREAS Marcel Vallotton, the owner of the property legally described as Pt. Of the NE ¼ Section 12-7-16 WPM and located at approximately 9 miles west of Glenboro in the R.M. of South Cypress, applied to the Council of the R.M. of South Cypress for approval of a Conditional Use Order under Zoning By-Law No. 1485 Part IV, Section 6, Table IV-I, in order to: Allow the establishment of a Rural Non-Farm Dwelling Site in the "A80" AGRICULTURAL DISTRICT (approx. 13.0 Acres) And after careful consideration of the application and any representations made for or against it, the Council of the R.M. of South Cypress in a meeting duly assembled on the 13th day of February A.D., 2007 Approved the said application Approval is given subject to the following conditions: The feedlot shall be removed. Approval shall expire if not acted upon within 12 months of the date of making. "carried"
#7706 J. S. Hamilton – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress award a grant in the amount of $714.00 to the Wawanesa-Oakland Community Development Corporation to aid in its’ operational costs associated with Wawanesa community promotional activities during the year 2007. "carried"
#7707 L. E. Coates – L. J. Berry WHEREAS as provided for in Section 365(2) of the Municipal Act, a Council may in any year designate the immediately preceding year or any earlier year as the year for which properties the taxes in respect of which are in arrears for the year must be offered for sale by auction to recover the tax arrears and costs; NOW THEREFORE BE IT RESOLVED that the Council of the R. M. of South Cypress designate Tax Year 2006 as the year for which properties the taxes in respect of which are in arrears (2005 taxes) must be fully paid prior to commencement of the 2007 Municipal Tax Sale and failing payment of all 2005 tax arrears the respective property will be offered for sale by auction in order to recover the tax arrears and costs; AND FURTHER BE IT RESOLVED that the Rural Municipality of South Cypress conduct this years’ Tax Sale at a suitable date and time, in the fall of the year 2007, as determined by the Chief Administrative Officer. #7708 L. E. Coates – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize a $500.00 grant to the Seniors Independent Services Board to aid in offsetting their operational costs during the year 2007. "carried"
#7709 L. J. Berry – J. S. Hamilton RESOLVED that the Council of the Rural Municipality of South Cypress authorize all members of Council and the Municipal Administrator to attend a one-day seminar on Municipal Weed Control issues, being hosted by Manitoba Agriculture and the Manitoba Weed Supervisors Association, which is to be held in Holland, Manitoba on Wednesday, March 21, 2007. "carried"
#7710 L. E. Coates – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize Council Members Leonard Berry, Jack Hamilton and Lloyd Coates to attend the Turtle Mountain Mutual Aid District hosted "Elected Officials Presentation" which is to be held in Belmont, Manitoba on Thursday March 8, 2007. "carried"
#7711 L. J. Berry – L. E. Coates RESOLVED that the Council of the Rural Municipality of South Cypress, authorize Reeve Earl E. Malyon to attend the Manitoba Agriculture/Manitoba Co-operative Association hosted seminar entitled "Bio-Fuels and Value Added Co-ops" which is being held in Portage la Prairie, Manitoba on February 21 and 22, 2007. "carried"
#7712 W. R. Cullen – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress authorize Council members Jack Hamilton, Leonard Berry and Lloyd Coates to attend a meeting regarding Southern Manitoba Rail Line Abandonment, which is being held in Roland, Manitoba on Friday February 16, 2007. "carried"
#7713 L. E. Coates – W. R. Cullen RESOLVED that the Rural Municipality of South Cypress authorize Reeve Earl E. Malyon, Deputy Reeve John S. Hamilton and Chief Administrative Officer Eric Plaetinck to attend the A.M.M. Western District 2007 Mayors, Reeves and CAO’s meeting which is to held in Glenboro, Manitoba on March 7, 2007. "carried"
#7714 L. E. Coates – W. R. Cullen RESOLVED that the Council of the Rural Municipality of South Cypress hold a special meeting on Monday, April 2, 2007 at 9:00 a.m. to set and adopt the Municipality’s Budgeted Operating Expenditures for fiscal year 2007. AND FURTHER BE IT RESOLVED that in compliance with Section 162(2) of The Municipal Act, the Council of the Rural Municipality of South Cypress hold a Public Hearing on Tuesday, April 10, 2007 at 1:30 p.m. in the R. M. of South Cypress Council Chambers in Glenboro, Manitoba for the purpose of presenting its Financial Plan for fiscal year 2007 and subsequently giving any person who wishes, opportunity to make representation, ask questions or register an objection to the Financial Plan so presented. "carried"
#7715 L. E. Coates – L. J. Berry RESOLVED that the Council of the Rural Municipality of South Cypress do now adjourn @ 3:40 p.m., to convene again at the next regular meeting scheduled for Tuesday, March 13, 2007 at 9:00 a.m. "carried"
