Minutes of the Inaugural and First
meeting of the 2007/2008 Council of the Rural Municipality of South Cypress held
in the Municipal Council Chambers at 618 Railway Avenue in Glenboro on Tuesday,
November 13, 2007 @ 8:30 a.m. Present at the Meeting: Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, Leonard K. Plett, Walter R. Cullen, and Chief Administrative Officer, Eric Plaetinck. Prior to the commencement of the meeting, in accordance with Section 101(1) of the Municipal Act, the Reeve and all Councillors each made and subscribed a Declaration of Qualification and Declaration of Office. The Chief Administrative Officer also made and subscribed a Declaration of Office. Reeve Earl E. Hamilton be appointed as Deputy Reeve of the Rural Municipality of South Cypress during the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Leonard J. Berry to the Board of the Cypress River Local Improvement Area for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Reeve Earl E. Malyon, Councillor Leonard J. Plett (Chairman) and Lloyd E. Coates to act as the Municipal Accounts/Finance Committee during the period November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Lloyd E. Coates to the Glenboro Area Veterinary Services Board for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Walter R. Cullen, Lloyd E. Coates, and Resident Ratepayers Glenn Dowd, David Naismith and Curtis Wytinck to act on the Glenboro Airport Commission for the term November 13, 2007 to November 12, 2008. “carried”

Plett and community resident Shirley Rutherford to the Western Manitoba Regional Library for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Walter R. Cullen to represent the Rural Municipality of South Cypress on the Souris River Recreation Commission for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Walter R.

Berry and Municipal Resident/Ratepayer Luella Outhwaite to act on the Board of the Glenboro South Cypress Wawanesa Handi Transit for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint resident ratepayer, Carol Lynn Malyon to represent the Rural Municipality of South Cypress on the Board of the Glenboro-South Cypress Seniors Independent Service, for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Lloyd E. Coates to represent the Rural Municipality of South Cypress on the Red Coat Trail Highway Association for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that we appoint Reeve Earl E. Malyon and Councillor John S. Hamilton to the Governing Board of the Glenboro Community Foundation Fund for the term November 13, 2007 to November 12, 2008. AND FURTHER RESOLVED that we appoint community resident Lorelie Mitchell to the Governing Board of the Glenboro Community Foundation Fund for the one tem November 13, 2007 to November 12, 2008 and that we appoint community resident Mel Ham to the Governing Board of the Glenboro Community Foundation Fund for the two year term November 13, 2007 to November 10, 2009. “carried” RESOLVED that Council appoint John S. Hamilton, Leonard J. Berry and resident ratepayer James Abernethy to the Board of Glenboro-South Cypress Weed Control District for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Leonard J. Berry to the Board of the Glenboro Elderly Persons Housing Unit (Glen Haven) for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Councillors John S. Hamilton and Leonard J. Berry represent the Rural Municipality of South Cypress on the Glenboro Wastes Disposal Grounds Management Committee during the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Leonard K. Plett and community residents Lillian Blain, Ruth Christie, and Nora Ediger to the Glenboro-South Cypress Municipal Heritage Committee for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Reeve Earl E. Malyon to the Heartland Gas Initiative Working Committee for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint John S. Hamilton to represent the Rural Municipality of South Cypress to the Trans Canada Trail Committee, during the period of November 13, 2007 to November 12, 2008.
“carried” RESOLVED that the Council of the Rural Municipality of South Cypress appoint resident ratepayer, Eddie Plett of Wawanesa, Manitoba to the Board of the Wawanesa-Oakland Community Development Corporation for the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Reeve Earl E. Malyon to represent the Rural Municipality of South Cypress on the Spirit Sands Co-operative Housing Board during the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that Council appoint Reeve Earl E. Malyon (Councillor John S. Hamilton as an alternate) to represent the Rural Municipality of South Cypress on the Assiniboine Delta Aquifer Management Round Table during the term November 13, 2007 to November 12, 2008. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1812, as amended, (Vis-à-vis 2007/2008 Council Members Indemnity, Compensation) and that it be signed by the Reeve and the Municipal Administrator, sealed & delivered. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress give first reading to By-Law #1813 (Vis-à-vis 2007 Tax and Debt Cancellations). “carried”

Appointments of Year 2008 Municipal Fireguardians). “carried” RESOLVED that the Council of the Rural Municipality of South Cypress give first reading to By-Law #1815 (Vis-à-vis Appointments of Year 2008 Poundkeepers, Appraisers and Cemetery Sextons). “carried” RESOLVED that the Council of The Rural Municipality of South Cypress appoint W. Jack Mooney for a one-year term, November 13th, 2007 to November 12th, 2008 and Eric Moore for a two-year term, November 13th, 2007 to November 10th, 2009 to the Oak Creek Sub District of The Assiniboine Hills Conservation District; AND FURTHER BE IT RESOLVED that the Council of The Rural Municipality of South Cypress appoint James Abernethy for a one-year term, November 13th, 2007 to November 12th, 2008 and Cam Hamilton for a two-year term, November 13th, 2007 to November 10th, 2009 to the Epinette-Willow Sub District of The Assiniboine Hills Conservation District;
AND FURTHER BE IT RESOLVED that the Council of The Rural Municipality of South Cypress appoint Councillor Walter Cullen for a one-year term, November 13th, 2007 to November 12th, 2008 to the Lower Souris Sub District of The Assiniboine Hills Conservation District. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize Councillors John S. Hamilton and Walter
R. Cullen to attend the Manitoba Conservation Districts Association 32nd
Annual Convention, which is to be held in Brandon, Manitoba on December 12th,
2007. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize Shilo Farms Ltd. to bury a 6” irrigation water pipeline under the Municipal road between the NW of Section 30 and the SW of Section 31 all in Township 8, Range 16W1, AND FURTHER BE IT RESOLVED that it is understood by both parties that all necessary work and materials was and continues to be the responsibility of the applicant with the installation and existing pipeline requiring the continual consent of Council. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress ratify the acquisition, in the 2007 season, of 17,258 cubic yards of gravel from the Craig Bell Gravel Pit located at the SW 10-8-16 WPM for and at the agreed price plus 6% G.S.T. and the provincial rehabilitation tax. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress ratify the acquisition, in the 2007 season, of 9,725 cubic yards of shale from the Rudy Kovar Shale Pit located at the SE 21-6-14 WPM for and at the agreed price plus G.S.T and the provincial rehabilitation tax. (Said shale is to be dug out and stockpiled at Municipal expense). “carried” RESOLVED that the Council of the Rural Municipality of South Cypress contract the services of Mr. W. J. Outhwaite of Stockton, Manitoba to clean out snow from the back lanes in the Hamlet of Stockton during the 2007/2008 winter with a Caterpillar 950 Loader, on an “as required” basis: Conditions of the Contract are: That the required snow clearing be completed within a reasonable period of time after a snowfall/snow drifting. That billing for any such work is submitted to the R. M. immediately after each time such work is completed. That it is estimated that the normal clean out of all back lanes in Stockton will take approximately 1 hour of said loader time for each complete cleaning. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize a grant in the amount of $500.00 payable to the Glenboro Community Development Corporation to aid in offsetting the costs they incurred in the 2007 television advertisements regarding public awareness of the restricted but otherwise open PTH #2 route via Wawanesa and the promotion of the Glenboro district. AND FURTHER BE IT RESOLVED that a condition of the said grant be that the Village of Glenboro also award a like amount to the Glenboro Community Development Corporation for same. “carried” At a Public Hearing held at 11:00 a.m., in regard to Conditional Use Application #CU12-07-SC, no representation was received. CONDITIONAL USE ORDER NO: CU12-07-SC WHEREAS Brian Jackson (applicant) for Shelly Anderson (owner) the owner of the property legally described as Pt. of the SW ¼ Sec. 18-8-16WPM and located at approximately 1 ½ miles west and 1 ½ miles north of Treesbank in the Rural Municipality of South Cypress, applied to the Council of the Rural Municipality of South Cypress for approval of a conditional use order under zoning By-Law No. 1485 Part IV, Section 6, Table IV-I, in order to: Allow the establishment of a Rural Non-Farm Dwelling Site in the “A80” Agricultural District. (Approximately 3.4 acres) And after careful consideration of the application and any representations made for or against it, the Council of the Rural Municipality of South Cypress in a meeting duly assembled on the 13th of November A.D., 2007. Approved the said application. Approval is given subject to the following conditions: None specified! Approval shall expire if not acted upon within 12 months of the date of making. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress appoint Councillors Walter R. Cullen, Leonard J. Berry and Leonard K. Plett to represent the Municipality on the Cypress Planning District’s Livestock Production Operations Review Committee for the term November 13th, 2007 to November 12th, 2008. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize the total payment of $22,221.83, to the Glenboro–South Cypress Weed Control District, for labour services, equipment time and herbicide provided in the control of noxious weeds on designated Municipal roadside ditches during the 2007 season. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress support the Glenboro/Carberry High School Hockey Team by advertising in their 2007/2008 season’s games program at a total cost of $25.00. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress be an “Option One” sponsor of the Wawanesa Jets Senior Hockey Club and thereby advertise in their 2007/2008 Season’s home Hockey Game Programs at a cost of $50.00. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress award a grant in the amount of $25.00 to the Glenboro U.C.T. Club to assist in offsetting the costs of hosting the Glenboro Santa Claus Parade on Saturday December 1, 2007. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize Maureena McPhail to attend the M.M.A.A.
Educational Seminar, on the topic of Municipal Finance and Capital Accounting (PSAB),
being held in Brandon, Manitoba on Friday January 18th, 2008. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2007 accounts from cheque # 4501 to and including cheque # 4569, as submitted to Council by the Municipal Administrator. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress do now adjourn @ 1:35 p.m. to convene again at the next regular meeting scheduled for Tuesday December 11th, 2007 at 8:30 a.m. “carried” |
