Minutes of the second regular meeting of the 2008/2009 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Avenue in Glenboro on Tuesday, December 9, 2008 at 8:30 a.m. Present at the meeting; Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Leonard K. Plett, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, presiding,

regular meeting of Council held on Wednesday, November 12th, 2008 be
taken as read and approved, all statutory requirements having been fulfilled. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress give second and third reading to By-law #1820
(vis-à-vis 2008 tax and debt cancellations), and that it be signed by
the Reeve and Municipal Administrator, sealed and delivered. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress give second and third reading to By-law #1821
(vis-à-vis Appointments of the 2009 Municipal Fireguardians), and that
it be signed by the Reeve and Municipal Administrator, sealed and delivered. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress give second and third reading to By-law #1822
(vis-à-vis Appointments of the 2009 Poundkeepers, Appraisers and Cemetery
Sextons), and that it be signed by the Reeve and Municipal Administrator, sealed
and delivered. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress give first reading to By-law #1823, (vis-à-vis
2009 Borrowing/Overdraft Authorization @ Westoba Credit Union Ltd., Glenboro
Branch). “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize the payment of fiscal year 2008 accounts
from cheque #5690 to and including cheque #5765, as submitted to Council by the
Municipal Administrator. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize the Chief Administrative Officer to
advertise for the invitation of applications for the seasonal employment
position of Municipal Heavy Equipment Operator, with duties to commence in the
spring of 2009. “carried” RESOLVED that the Council of The Rural
Municipality of South Cypress ratify the acquisition, in the 2008 season, of
14,333 cubic yards of gravel from the Craig Bell Gravel Pit located at the SW
10-8-16 WPM for and at the agreed price plus 5% G.S.T. and the provincial
rehabilitation tax. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress appoint Allan Bartram as full-time Municipal
Equipment Operator and Foreman for the Year 2009, (Gravel Truck/Loader Operator
in the summer season and Snowplough Operator in the winter Season as per terms
& conditions to be specified in his year 2009 Employment Agreement. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress appoint Paul Wilton as Full-Time Municipal
Equipment Operator for the Year 2009, as per terms & conditions to be
specified in his year 2009 Employment Agreement. “carried” At a duly called public hearing held at
11:00 a.m., in regard to Variation Order application #V06-08-SC, no
representation was made either for or against the application. Variation order by the R. M. of South
Cypress Variation Order No: V06-08-SC Whereas Kim Robinson, applicant, for
Margaret Elaine Clark, owner of the property legally described as Pt. SW 20-8-16
WPM, (South Cypress) and located approximately 2 miles North and ½ mile West
of Treesbank, applied to the Council of the R. M. of South Cypress to vary
the application of Part IV, Section 8, Zoning By-Law No.1485 provided under Part
6 of the planning Act as it applies to the property, in order to vary the
established requirements: From:
Front Yard Setback for an accessory building in an “A80” Rural
District of a minimum 125 feet To:
Front Yard Setback for an accessory building in an “A80” Rural
District of a minimum 60 feet For the purpose of locating an older
mobile home to be used as a storage building and a workshop And after careful consideration of the
application and any representations made for or against the variation sought by
the applicant, The R. M. of South Cypress in a meeting
duly assembled this 9th day of December 2008, Approved the said variation. Approval is given subject to the
following conditions: This order shall expire if not acted
upon within 12 months of the date of making. “carried” At a duly called public hearing held at
11:15 a.m., in regard to Variation Order application #V13-08-SC, no
representation was made either for or against the application. Variation order by the R.M. of South
Cypress Variation Order No: V13-08-SC Whereas Daryl Desrochers and Charlene
Angus, owner of the property legally described as Pt. SE ¼ 18-7-16 WPM, (South
Cypress) and located at the NE corner of the intersection of PTH #2 and PTH #18
applied to the Council of the R. M. of South Cypress to vary the application of
Part IV, Section 8, Zoning By-Law No.1485 provided under Part 6 of the Planning
Act as it applies to the property, in order to vary the established
requirements: From:
Minimum front yard setback of 125 feet in an “A80” Rural District To:
Minimum front yard setback of 70 feet in an “A80” Rural District For the purpose of constructing an
attached garage onto an existing residence. And after careful consideration of the
application and any representations made for or against the variation sought by
the applicant, The R.M. of South Cypress in a meeting
duly assembled this 9th day of December 2008, Approved the said variation. Approval is given subject to the
following conditions: That authorization also be obtained,
from the Manitoba Department of Highways, for the said setback variation. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress enter into an agreement with Waste Management of
Brandon, Manitoba to provide recycling services in the Hamlet of Treesbank at a
cost of $ 50.85 per month plus applicable taxes. “carried”
WHEREAS in accordance with Section 163
of the Municipal Act, the Council of the Rural Municipality of South Cypress has
made an interim operating budget for all the expenditures of the Municipality
for the period January
1, 2009 until the adoption of the annual estimates; NOW THEREFOR BE IT RESOLVED that the
provisional estimates as set out in Schedule “A” be hereby approved by the
Council of the Rural Municipality of South Cypress.

that the Council of the Rural Municipality of South Cypress do now adjourn @
12:45 p.m., to convene again at the next regular meeting scheduled for Tuesday,
