Minutes of the sixth regular meeting of the 2008/2009 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, April 14, 2009 at 8:30 a.m. Present at the meeting, Reeve Earl E. Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, Leonard K. Plett, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, presiding, called the meeting to order at 8:30 a.m. During the meeting, at the time
indicated, Council conducted the noted Public Hearing and also met with the

Soil/Water Testing -
8:45 a.m. RESOLVED that the minutes of the last regular meeting of Council held on Tuesday, March 10th, 2009 and minutes of a special meeting held on Tuesday, April 7th, 2009 be taken as read and approved, all statutory requirements having been fulfilled. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize Municipal Equipment Operators Allan Bartram, Paul Wilton and Matthew Neale to attend the Manitoba Good Roads Association’s public works training seminar entitled “Geotextile Design in Highway Construction” and the Association of Manitoba Municipalities Trade Show, both being held in Brandon, Manitoba on Wednesday April 15th, 2009. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize seasonal grader operator, Matthew Neale, to commence his 2009 season employment on Monday, April 13, 2009. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress ratify the attendance of Public Works Personnel, Allan Bartram, Paul Wilton and Matthew Neale to the Toromont “Caterpillar Equipment Repair and Maintenance Seminar”, which was held in Brandon on Thursday April 9, 2009. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2009 accounts from cheque #5961 to and including cheque #6024, as submitted to Council by the Chief Administrative Officer. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize the Chief Administrative Officer to
purchase an appropriate computer for the Municipal Shop Office. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize Manitoba Transportation & Government
Services, in the spring of 2009, to apply a dust control product (approximately
2,400 litres of calcium chloride) onto 1,475 feet length of Provincial Road
#530, along the Hamlet of Treesbank, AND FURTHER BE IT RESOLVED THAT the
total cost of this application, estimated a $600.00, be paid by the
Municipality, AND FURTHER BE IT RESOLVED THAT the
Rural Municipality of South Cypress accepts no responsibility for the
effectiveness of the dust control chemical. “carried” At a duly called public hearing
held at 10:30 a.m., in regard to Conditional Use application #CU01-09-SC, no
representation was made either for or against the application. CONDITIONAL USE ORDER NO: CU01-09-SC WHEREAS Peter and Robyn Munroe
(applicants) for Dwayne and Kathy McLean – owners of the property legally
described as Pt. of the NE ¼ Sec. 20-8-16WPM and located at approximately 3
miles North of Treesbank in the Rural Municipality of South Cypress, applied to
the Council of the Rural Municipality of South Cypress for approval of a
Conditional Use Order under Zoning By-Law #1485 Part IV, Section 6, Table IV-I,
in order to: Allow the establishment of a Rural
Non-Farm Dwelling Site in the “A80” Agricultural District. (Approximately 1
acre) And after careful consideration of the
application and any representations made for or against it, the Council of the
Rural Municipality of South Cypress in a meeting duly assembled on the 14th
day of April A.D., 2009, Approved the said application Approval is given subject to the
following conditions: That any Residence of Accessory
Buildings meet the required setbacks as per South Cypress Zoning By-Law No.
1485, Part IV, Table IV, Table IV-II That any Onsite Wastewater Management
System be approved by Manitoba Conservation Approval shall expire if not acted upon
within 12 months of the date of making. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress award a 2009 grant in the amount of $1,000.00 to
the Wawanesa and District Fire Department to aid in purchasing training
equipment for their facility. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress appoint Ms. Kim Robinson of Wawanesa, Manitoba as
Operator of the Stockton Ferry for the 2009 Season (5 day/40 hour work per week;
plus an allowance for 13 hours of overtime per week) and as per further terms
and conditions to be specified in her 2009 employment agreement, AND FURTHER BE IT RESOLVED that Ms.
Robinson’s term of employment commence in the spring 2009, at the call of
Council, for the period until river freeze up in the Fall of 2009, AND FURTHER BE IT RESOLVED that the
entire 2009 employment term be recognized as Ms. Robinson’s initial
probationary period, which will be under review by Council to determine whether
same is being served satisfactorily. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress set the following days and hours of operation for
the Stockton Ferry during the 2009 season: Open 5 days per week; specially:
SUNDAY, MONDAY, TUESDAY, FRIDAY AND SATURDAY, for the following hours:
The Ferry will be technically
closed on each of the noted days between the hours of 5:00 p.m. to 8:00 a.m.,
however an operator will be available on an “as required” basis, to
accommodate crossing requests from 6:00 a.m. to 8:00 a.m. and 5:00 p.m. to
midnight; The Ferry will also be technically
closed all day WEDNESDAY AND THURSDAY OF EACH WEEK AND ALL STATUTORY HOLIDAYS
throughout the season, however an operator will be available on an “as
required” basis, to accommodate crossing requests during said days from 6:00
a.m. to 12:30 p.m. and 1:30 p.m. to midnight. “carried” At a
Public Hearing held at 11:30 a.m. in regard to the Rural Municipality of South
Cypress’ 2009 Financial Plan, there was no representation made by the public. RESOLVED that Council adopt the
Financial Plan of the Rural Municipality of South Cypress for Fiscal Year 2009
and the proposed Capital Expenditures Program for the Rural Municipality of
South Cypress for the years 2010 to and including 2014, as presented at
today’s public hearing, a copy of which is attached hereto and marked as
Schedule “A”. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress give first reading to By-law #1825 (Vis-à-vis the
Schools and Municipal Tax Levy for fiscal year 2009).
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress, together with the Council of the Village of
Glenboro, enter into an agreement with Mr. Gary Nestibo of Municipal Waste
Management Ltd. of Goodlands, Manitoba for waste handling /transfer services
required during the period May 1, 2009 to April 30, 2011, and as per terms and
conditions to be specified in a formal services agreement, dated April 14, 2009.
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress grant office space and equipment storage area to
the Glenboro-South Cypress Weed Control District, at its property located at 497
South Railway Glenboro, Manitoba, during the term January 1, 2009 to December
31, 2009 at a total rental cost of $2,600.00.
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize Councillors Leonard J. Berry and Walter
R. Cullen to attend the Manitoba Intergovernmental Affairs workshop regarding
the Provincial Land Use Policies Review being held in Souris on Wednesday, April
22, 2009.
“carried” WHEREAS the residents of the area
wherein the Medical Services are provided and managed by the Assiniboine
Regional Health Authority have experienced and continue to experience a serious
shortage of physicians and emergency services; AND WHEREAS the Assiniboine Regional
Health Authority has been unable to recruit a sufficient number of physicians to
operate the areas clinics, hospitals and emergency services; AND WHEREAS it is strongly believed that
the operation of a rural satellite medical School at Brandon University would
produce physicians prepared to practice in the Assiniboine Regional Health
Authority area; NOW THEREFORE BE IT RESOLVED that the
Council of the Rural Municipality of South Cypress by resolution supports and
encourages the creation and operation of a rural satellite Medical School at
Brandon University.
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize the payment to Emergency Co-ordinator,
Garth McIntyre of Glenboro, Manitoba, representing the Municipality’s share of
costs for services provided by Mr. McIntyre during the year 2008 in activities
associated with his position as coordinator for the Spruce lakes Emergency
Response team and the Village of Glenboro an Rural Municipality of South Cypress
Emergency Preparedness Plan.
“carried” RESOLVED that the Rural Municipality of
South Cypress award a grant in the amount of $1,200.00 to the Skalholt Cemetery
Committee to aid in offsetting the costs in the purchase of a new Cub Cadet
LTX1042 19HP 42” hydrostatic lawn tractor to be used in the maintenance of
their cemetery.
“carried” RESOLVED that the Council of the Rural Municipality of South Cypress, in accordance with the Provincial Assessment Services Branch schedule, conduct its “Board of Revision” for the 2010 property assessments, on Tuesday October 20, 2009 at 10:00 a.m.
“carried” WHEREAS the Council of the Rural Municipality of South Cypress has decided to redistribute $10,050.00 from its year 2009 share of funds it receives from the Provincial Government’s VLT revenues, to aid local non-profit organizations with capital projects; NOW THEREFORE BE IT RESOLVED that the
Council of the Rural Municipality of South Cypress award the following community
organizations the noted grants to assist with purchase and/or improvement
projects they will be undertaking;
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress renew its Certificates of Insurance coverage for
the period April 1, 2009 to April 1, 2010 under the A.M.M. Municipal General
Insurance Program thru the Insurance Brokerage Firm of Hayhurst Elias Dudek Inc.
and thereby pay the respective premium, that will be based on coverage and
values specified in certificate number AMM036. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize Chief Administrative Officer, Eric
Plaetinck to attend the 78th Annual Conference of the Manitoba
Municipal Administrators Association Inc. being held in Brandon, Manitoba on
April 27 –29, 2009. “carried”
WHEREAS the Province of Manitoba
reimburses Municipalities up to 60% of the costs incurred for application and
insecticide in the control of grasshoppers along public right of ways; AND WHEREAS noxious weed growth along
public right of ways has a similar negative impact on adjoining crops and
hay-lands as grasshoppers do on same; NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of South Cypress request the AMM to lobby Manitoba Conservation to establish a like funding program for the control of noxious weeds on public right of ways. “carried” WHEREAS public recreation facilities
such as skating arenas, swimming pools and various recreation centres are
integral to the health, social connectedness and quality of life in communities; AND WHEREAS overwhelming operational
costs of skating arenas such as insurance premiums and electrical costs along
with limited means of raising additional revenue to offset said costs are
jeopardizing the financial sustainability of this essential winter recreation
facility; NOW THEREFORE BE IT RESOLVED that the
Council of the Rural Municipality of South Cypress request the AMM to lobby the
Provincial Government to develop a new rate formula, in order to effect a
significant decrease in hydro costs for community owned arenas. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress do now adjourn @ 3:10 p.m., to convene again at
the next regular meeting scheduled for Tuesday, May 12th, 2009 at
