Minutes of the second regular
meeting of the 2009/2010 Council of the Rural Municipality of South Cypress held
in the Municipal Council Chambers at 618 Railway Avenue in Glenboro on Tuesday,
December 8, 2009 at 8:30 a.m. Present at the meeting: Reeve Earl E.
Malyon, Councillors John S. Hamilton, Lloyd E. Coates, Leonard K. Plett, Walter
R. Cullen and Chief Administrative Officer, Eric Plaetinck.
Regrets: Leonard J. Berry. Reeve Earl E. Malyon, presiding, called
the meeting to order at 8:45 a.m. During the meeting, at the time
indicated, Council met with the following delegations: Allan Bartram } Work Progress Report and 2010 Paul Wilton } Employment, Wages & Conditions John McEntee } Various Planning Matters RESOLVED that the minutes of the last
regular meeting of Council held on Wednesday, November 10th, 2009 be
taken as read and approved, all statutory requirements having been fulfilled.

RESOLVED that the Council of the Rural
Municipality of South Cypress give second and third reading to By-law #1827
(vis-à-vis 2009 tax and debt cancellations), and that it be signed by
the Reeve and Municipal Administrator, sealed and delivered.
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress give second and third reading to By-law #1828
(vis-à-vis Appointments of the 2010 Municipal Fireguardians), and that
it be signed by the Reeve and Municipal Administrator, sealed and delivered.

RESOLVED that the Council of the Rural Municipality of South Cypress give second and third reading to By-law #1829 (vis-à-vis Appointments of the 2010 Poundkeepers, Appraisers and Cemetery Sextons), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress give first reading to By-law #1830, (vis-à-vis 2010 Borrowing/Overdraft Authorization @ Westoba Credit Union Ltd., Glenboro Branch). “carried” RESOLVED that the Council of the Rural Municipality of South Cypress give first reading to By-law #1831, (vis-à-vis the re-formation of the Spruce Lakes Recreation Commission). “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2009 accounts from cheque #6477 to and including cheque #6557, as submitted to Council by the Municipal Administrator. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress accept the tender submitted by Mr. Victor Hiebert,
of Killarney, Manitoba for the purchase of a used 1967 CASE 440 Gas
Tractor serial #8289845, for and at the tendered price of $ 2,000.00, plus
applicable taxes and sold in “as-is; where-is” condition. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress accept the tender submitted by Mr. Shane Jonsson, of Cypress River, Manitoba for the purchase of a used 1985 – 5 HP upright stationary CAMPBELL HAUSFELD air compressor, for and at the tendered price of $125.00 plus applicable taxes and sold in “as-is; where-is” condition. “carried” RESOLVED that the Council of The Rural Municipality of South Cypress ratify the acquisition, in the 2009 season, of 18,430 cubic yards of gravel from the Craig Bell Gravel Pit located at the SW 10-8-16 WPM for and at the agreed price plus 5% G.S.T. and the provincial rehabilitation tax. “carried” WHEREAS Mr. Matthew Neale of Glenboro,
Manitoba has, in the opinion of the Council of the Rural Municipality of South
Cypress, successfully served his probationary employment term (April 13, 2009 to
December 2, 2009) as Municipal Grader Operator; NOW THEREFORE BE IT RESOLVED that the
Council of the Rural Municipality of South Cypress appoint, Mr. Matthew Neale as
Permanent Seasonal Grader Operator for the Municipality, with such employment to
commence in the Spring of 2010, subject to agreed upon wages and conditions,
which is to be specified in his annual employment agreement.
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress appoint Allan Bartram as full-time Municipal
Equipment Operator and Foreman for the Year 2010, (Gravel Truck/Loader Operator
in the summer season and Snowplough Operator in the winter Season as per terms
& conditions to be specified in his year 2010 Employment Agreement.

RESOLVED that the Council of the Rural
Municipality of South Cypress appoint Paul Wilton as full-time Municipal
Equipment Operator for the Year 2010, as per terms & conditions to be
specified in his year 2010 Employment Agreement.
“carried” WHEREAS Ms. Kim Robinson of Treesbank,
Manitoba has, in the opinion of the Council of the Rural Municipality of South
Cypress, successfully served her probationary employment term (May 10, 2009 to
December 1, 2009) as Operator of the Stockton Ferry; NOW THEREFORE BE IT RESOLVED that the
Council of the Rural Municipality of South Cypress grant, Ms. Robinson,
permanent seasonal employment as Operator of the Stockton Ferry, subject to
agreed upon wages and conditions, which is to be specified in her annual
seasonal employment agreement.
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress support the Glenboro-South Cypress Fire Department
in it’s hosting of the 2010 Manitoba Provincial Firefighters Curling
Championship, being held in Glenboro, Manitoba on February 4th – 7th,
2010, and thereby advertise at the said event at a “4 foot” support
level at a cost of $ 500.00.
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress adopt the awarding criteria of the “R. M. of
South Cypress Scholarship Fund” as submitted by the Board of the Glenboro
Community Foundation Fund, attached herewith and marked as Appendix “S”. “carried” appendix “s” Criteria for the Rural Municipality of
South Cypress scholarship Fund
This Scholarship is available to any graduating student from the Glenboro
High School who must leave his/her home area for study and who is enrolling to
study courses in the health care field, or, failing to find a student in the
health sciences, the Scholarship may be awarded to a student enrolling to take
agricultural courses;
The selection committee will be the Scholarship Selection Committee at
the Glenboro High School;
The chosen student will demonstrate academic achievement, worthy of
acceptance at accredited institutions in Canada, show evidence of community
volunteerism and participation in sports or club activities such as 4-H, travel
or drama;
If the student awarded the Scholarship does not start a course of study
within 15 months of graduation, then this Scholarship will be forfeited and the
funds will remain within the Rural Municipality of South Cypress Scholarship
Fund; A representative of the Rural Municipality of South Cypress will present the Scholarship at the annual graduation ceremony at the Glenboro School. If the Glenboro School ceases to exist, then the Scholarship will be awarded to a student from the area who is graduating from the recognized institution for the area. WHEREAS in accordance with Section 163
of the Municipal Act, the Council of the Rural Municipality of South Cypress has
made an interim operating budget for all the expenditures of the Municipality
for the period January
1, 2010 until the adoption of the annual estimates; NOW THEREFORE BE IT RESOLVED that the
provisional estimates as set out in Schedule “A” be hereby approved by the
Council of the Rural Municipality of South Cypress. “carried” RESOLVED that the plan of Subdivision of
Land described as follows: Being part of the S ½ of SE ¼ of
Section 19, Township 7, Range 13W1, as shown on a drawing and being attached to
an application for subdivision file #14-4187-09-4566 and being submitted by the
registered owners, Ellis, Sheila and James Drinkwater; be hereby approved by the Council of the
Rural Municipality of South Cypress. Approval is given subject to the
following conditions: That a conditional use order be obtained
to permit the non-farm single-family dwelling site within the”A80” Zone; That a variation order be obtained
reducing the minimum site width requirement for a non-farm single family
dwelling from 300 feet to 214 feet; That any sewage disposal system be
installed and approved in accordance with the “On Site Wastewater Management
System Regulations”. “carried” RESOLVED
that the Council of the Rural Municipality of South Cypress proclaim Saturday
May 29th, 2010 as the first annual “Day of the Honey Bee”. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress do now adjourn @ 12:20 p.m., to convene again at
the next regular meeting scheduled for Tuesday, January 12th, 2010 at
8:30 a.m. “carried” |
