Minutes of the fourth regular meeting of
the 2009/2010 Council of the Rural Municipality of South Cypress held in the
Municipal/Village Council Chambers at 618 Railway Avenue, Glenboro, Manitoba, on
Tuesday, February 9th, 2010 at 8:30 a.m. Present at the Meeting, Reeve Earl E.
Malyon, Councillors Leonard J. Berry, Lloyd E. Coates, John S. Hamilton, Leonard
K. Plett, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, presiding, called
the meeting to order at 8:30 a.m. During the meeting, at the time indicated, Council conducted the noted Public Hearings and also met with the following delegations. regular meeting of Council held on Tuesday January 12th, 2010 be
taken as circulated and approved, all statutory requirements having been
fulfilled. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress give second and third reading to By-law #1832,
(vis-à-vis the appointment of Eric Plaetinck as the 2010 Chief Administrative
Officer), and that it be signed by the Reeve and Municipal Administrator, sealed
and delivered. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize the payment of fiscal year 2009 accounts
from cheque #6611 to and including cheque #6617, as submitted to Council by the
Municipal Administrator. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize the payment of fiscal year 2010 accounts
from cheque #6646 to and including cheque #6697 as submitted to Council by the
Administrator. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress appoint Ms. Kim Robinson of Wawanesa, Manitoba as
Operator of the Stockton Ferry for the 2010 Season at the agreed to remuneration
and as per further terms and conditions to be specified in her 2010 employment
agreement, AND FURTHER BE IT RESOLVED that Ms.
Robinson be eligible to become a member in the AMM/HED Municipal Health and
Dental program (Plan III – Single Plan) commencing her employment start date
in the spring of 2010, with the understanding that the entire monthly premium
required in respective coverage under the A.M.M. Extended Health & Dental
Insurance Program (Plan III) single coverage be paid entirely by the
Municipality for the full calendar year, AND FURTHER BE IT RESOLVED that Ms.
Robinson’s term of employment commence in the spring 2010, at the call of
Council, for the period until river freeze up in the Fall of 2010. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize all members of Council and the Municipal Administrator to attend a one-day seminar on Municipal Weed Control issues, being hosted by Manitoba Agriculture and the Manitoba Weed Supervisors Association, which is to be held in Carberry, Manitoba on Wednesday, March 17th, 2010. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress support the development of the newly initiated
“Central Assiniboine and Lower Souris River Integrated Watershed Management
Plan” and thereby authorize Reeve Earl E. Malyon to sign the respective
“Agreement in Principle”. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress apply to Manitoba Transportation and Government
Services for a year 2010 grant of up to $1,518.50 for improvements to designated
portions of Provincial Road #530, North of P.T.H. #2 to the Hamlet of Treesbank. “carried” RESOLVED that the year 2010 spring road
restrictions for designated municipal roads within the limits of the R.M. of
South Cypress, will commence on or after March 15, 2010; (actual implementation
date dependent on weather conditions) and shall remain in effect for a period of
up to 12 weeks, as determined by Council; The following specified municipal roads,
lying within the Rural Municipality of South Cypress, which are classified as a
“B Highway”, shall be weight restricted, when so posted, to 65% of normal
axle loads; 1 mile of Public Road lying within
Section 3; Township 7; Range 14WPM, referred to as the I.P.L. Road, and; 3 miles of Public Road #41N lying
directly north of Sections 25 and 26; Township 7; Range 14WPM and directly north
of Section 30; Township 7; Range 13 WPM, and; 7 miles of Public Road #78W from P.T.H.
#2 to Municipal Road #45N With the exception of the above noted
roads, all other municipal roads, within the limits of the Rural Municipality of
South Cypress will not be subject to spring weight restrictions. “carried” At a Public Hearing held at 10:30 a.m. and 10:40 a.m. respectively, in regard to Conditional Use application #CU01-10-SC, and Variation Order application #V01-10-SC the only representation made, was by the applicant, Jim, Nancy and William Drinkwater. CONDITIONAL USE ORDER NO:
CU01-10-SC WHEREAS James Drinkwater, applicant for
James, Ellis and Sheila Drinkwater, owners of the property legally described as
Pt. SE ¼ 19-7-13WPM and located at approximately 3 miles East and 1 mile North
of Glenboro in the R. M. of South Cypress, applied to the Council of the R. M.
of South Cypress for approval of a Conditional Use Order under Zoning By-Law No.
1485 Part IV, Section 6, Table IV-I, in order to: “Establish a single-family rural
non-farm dwelling site in an A80 Rural District. (214 feet wide by 450 feet deep
– approximately 2.2 acres)” And after careful consideration of the
application and any representations made for or against it, the Council of the
R. M. of South Cypress in a meeting duly assembled on the 9th day of
February AD., 2010. Approved the said application. Approval is given subject to the
following conditions: None
Specified. Approval shall expire if not acted upon
within 12 months of the date of making. “carried” VARIATION ORDER NO: VO1-10-SC WHEREAS James Drinkwater, applicant, for
James, Ellis and Sheila Drinkwater, owners of the property legally described as
Pt. SE 19-7-13 WPM, (South Cypress) and located at approximately 3 miles East
and 1 mile North of Glenboro, applied to the Council of the R. M. of South
Cypress to vary the application of Part IV, Section 8, Table IV-II (Bulk),
Zoning By-law No. 1485 provided under Part 6 of the Planning Act as it applies
to the property, in order to vary the established requirements: From: Minimum site width of 300 feet for
a Rural Non-Farm Dwelling Site. To:
Minimum site width of 214 feet for a Rural Non-Farm Dwelling Site. For the purpose of establishing a
single-family rural non-farm dwelling site within a location that is bounded by
an existing farmyard and existing shelterbelts. And after careful consideration of the
application and any representations made for or against the variation sought by
the applicant, James Drinkwater, The R. M. of South Cypress in meeting
duly assembled this 9th day of February 2010, Approved, the said Variation.
Approval is given subject to the following conditions: (none Specified This order shall expire if not acted
upon within 12 months of the date of making. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress accept the tender submitted by the Rural
Municipality of Ethelbert for the purchase of a used 2000 DeCap 39’, hopper
bottom, close under load, air ride, gravel trailer serial number
2D9DS5C31YL017521, c/w electric tarp, in “where-is; as is” safetied
condition, for and at the tendered price of twenty seven thousand, one hundred
dollars ($27,100.00) plus applicable taxes. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress support Sport Manitoba’s Westman Region Kidsport
Committee in their ongoing “Kidsport” program whereby funding is provided to
financially disadvantaged children in the Westman area so they may be able to
participate in community sports; AND FURTHER BE IT RESOLVED, that the
Council of the Rural Municipality of South Cypress authorize a 2010 Municipal
grant in the amount of $200.00 to aid in augmenting the Sport Manitoba Westman
Kidsport Trust Fund. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress support Manitoba Crime Stoppers Inc. by authorizing a Municipal 2010 Grant in the amount of $100.00. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress award a Municipal grant of up to $500.00 on the
basis of $100.00 per participating Municipal resident/ratepayer, to aid in the
regional palliative care co-ordinators’ staging of the 5th Annual
Camp Bridges being held at the Pembina Valley Bible Camp at Morden, Manitoba on
May 28 – 30, 2010.
“carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize all Council Members to attend the
surrounding School Division’s “Annual Educational Public Budget Consultation
Meetings” being held on respective dates/times at various locations. “carried” WHEREAS as provided for in Section
365(2) of the Municipal Act, a Council may in any year designate the immediately
preceding year or any earlier year as the year for which properties the taxes in
respect of which are in arrears for the year must be offered for sale by auction
to recover the tax arrears and costs; NOW THEREFORE BE IT RESOLVED that the
Council of the R. M. of South Cypress designate Tax Year 2009 as the year for
which properties the taxes in respect of which are in arrears (2008 taxes) must
be fully paid prior to the commencement of the 2010 Municipal Tax Sale and
failing payment of all 2008 tax arrears, the respective property will be offered
for sale by auction in order to recover the tax arrears and costs; AND FURTHER BE IT RESOLVED that the Rural Municipality of South Cypress conduct this years’ Tax Sale at a suitable date and time, in the fall of the year 2010, as determined by the Chief Administrative Officer. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize Reeve Earl Malyon, Councillor Walter
Cullen, and CAO Eric Plaetinck to participate in the DND/CFB Shilo Unexploded
Ordinance & Legacy Sites Program being staged in Carberry, Manitoba on
Thursday February 11, 2010. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress jointly with the Council of the Village of Glenboro, and in accordance with Section 10(1) and Section 10(2) of “The Municipal Councils and School Boards Election Act”, appoint area resident /ratepayer Agnes Witherspoon of Glenboro, Manitoba as “Senior Election Official” for the Rural Municipality of South Cypress and the Village of Glenboro commencing February 9th, 2010, at the agreed to hourly wage plus all “out of pocket” expenses and mileage expense, which is incurred by her while carrying out the responsibilities/duties of the said position. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress authorize the application of the following
wages/rates for the services provided, by duly appointed Election Officials, in
conjunction with the 2010 Municipal Election: Assistant Senior Election Official

plus all “out of pocket” expenses plus mileage, which is incurred by
the Election Official while carrying out the responsibilities and duties of the
said position. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress together with the Council of the Village of
Glenboro authorize the contacting of services of Mr. Ian Marshall o/s Glenabbey
Custom Welding, of Glenboro, Manitoba for the manufacturing and installation
of an expanded metal wheel chair access ramp and platform, for the north end
entrance of the Municipal/Village office, at and for the quoted price. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize Reeve Earl E. Malyon, Deputy Reeve John S. Hamilton and Chief Administrative Officer Eric Plaetinck to attend the A.M.M. Central District 2010 Mayors, Reeves and CAO’s meeting, which is being held in Treherne, Manitoba on March 18th, 2010. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress hold a special meeting on Wednesday, April 7, 2010
at 9:00 a.m. to set and adopt the Municipality’s Budgeted Operating
Expenditures for fiscal year 2010; AND FURTHER BE IT RESOLVED that in
compliance with Section 162(2) of The Municipal Act, the Council of the Rural
Municipality of South Cypress hold a Public Hearing on Tuesday, April 13, 2010
at 11:30 a.m. in the R. M. of South Cypress Council Chambers in Glenboro,
Manitoba for the purpose of presenting its Financial Plan for fiscal year 2010
and subsequently giving any person who wishes, opportunity to make
representation, ask questions or register an objection to the Financial Plan so
presented. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress do now adjourn @ 2:30 p.m., to convene again at
the next regular meeting scheduled for Tuesday, March 9th, 2010 at
8:30 a.m. “carried” |
