Minutes of the twelfth regular meeting of the 2009/2010 Council of the Rural Municipality of South Cypress held in the Municipal Council Chambers at 618 Railway Ave., Glenboro, Manitoba on Tuesday, October 12, 2010 at 8:30 a.m. Present at the meeting: Reeve Earl E.
Malyon, Councillors Leonard J. Berry, John S. Hamilton, Lloyd E. Coates, Leonard
K. Plett, Walter R. Cullen and Chief Administrative Officer, Eric Plaetinck. Reeve Earl E. Malyon, presiding, called
the meeting to order at 8:30 a.m. During the meeting, at the time
indicated, Council met with the following delegations: Allan Bartram } Municipal Equipment Operator’s Paul Wilton } Monthly Work Progress Report Matthew Neale } Upcoming Month’s Work Schedule John McEntee } Various Planning Matters RESOLVED that the minutes of the last
regular meeting of Council held on Tuesday September 14, 2010 be taken as read
and approved, all statutory requirements having been fulfilled. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize the payment of fiscal year 2010 accounts from cheque #7144 to and including cheque #7202, as submitted to Council by the Municipal Administrator. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress give second reading to By-Law #1835, (vis-a-vis
Municipal Zoning Amendments), subject to the following amendments: The land use “Telecommunication
Towers” become a conditional use rather than a permitted use for the “AG”,
“AML” and “AL” zones in Table IV-I of this By-Law, and Manure storage facility be added to
section 8.(26) SEPARATION DISTANCE REQUIREMENTS, clauses (b) and (c) as follows: (b) No new feedlot, manure storage facility or animal housing facility... (c) Any existing feedlot, manure storage facility or animal housing facility...
of this By-law. “carried”
RESOLVED that the Council of the Rural Municipality of South Cypress give third reading to By-Law #1835, (vis-a-vis Municipal Zoning Amendments), and that it be signed by the Reeve and Municipal Administrator, sealed and delivered. “carried – unanimous 6-0” RESOLVED that the Council of the Rural
Municipality of South Cypress give first reading to By-Law #1836 (Re: 2010/2011
Council members indemnity, remuneration and compensation). “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress contract the services of Devin Jarvis of Glenboro,
Manitoba to trim required trees, which are encroaching on the municipal right of
ways in 4 different locations in the Municipality. AND FURTHER BE IT RESOLVED that the fee
for this service be as quoted subject to the terms further specified in his
quote of September 24, 2010. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress, jointly with the Council of the Village of Glenboro, contribute a total of $500.00 to the Spruce Lakes Recreation District in its staging of an AED (Defibrillator)/CPR Course in Glenboro for up to 10 persons. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress authorize the participation of the Municipal Operators in the “Ground Force” Motor Grader Snowplow Training School (1 Day Classroom and 1 Day On Site Field “One-on-One”), as fully outlined in a an October 7th, 2010 services quote. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress lodge a complaint to the Manitoba Farm Practises Protection Board in order to obtain consideration for the installation of a HDPE cover on the Treesbank Hutterite Colony’s livestock manure holding tank located at the SE 6-8-16W1. “carried”
RESOLVED that the Council of the Rural
Municipality of South Cypress authorize Swansfleet Alliance of Bruxelles,
Manitoba to install and bury, at an appropriate depth, a water irrigation
pipeline in/under the Municipal road between NE ¼ of Section 11; Township 7;
Range 13WPM and the NW ¼ of Section 12; Township 7; Range 13WPM; AND FURTHER BE IT RESOLVED that all
necessary installation work and materials be the responsibility of the applicant
with the completed installation to meet the approval of the Ward Councillor and
furthermore that the applicant, as may be prescribed by the Municipality, be
required to repair, maintain, relocate and improve such irrigation pipeline in a
safe and workmanship fashion all which shall be at the sole and exclusive cost
of the applicant; AND FURTHER BE IT RESOLVED that the
applicant acquire a “Right of Way in a Municipal Road” Development Permit
for the said installation. AND FURTHER BE IT RESOLVED that the said installation approval be subject to the condition that the applicant, at his cost, attend to in due course, duly executed agreement, easement and respective signage for the affected roads. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress, jointly with the Village of Glenboro, offer
financial training assistance for up to 6 persons selected for the EMT program
during the 2010/2011 scholastic year. AND
FURTHER BE IT RESOLVED that any or all such selected students duly registered in
the said training program, upon application to the Glenboro Community
Development Corporation, will be considered for an “up front” repayable
loan in order to offset their initial registration, tuition
and textbook costs. AND
FURTHER BE IT RESOLVED that each of the six selected students be authorized to
receive a grant of up to a maximum of $670.00 upon the successful completion of
the program and the associated certification as provincial EMTech, on the
condition that the said student(s) provide at least one year of casual or
fulltime EMT service to the Glenboro-South Cypress area. “carried” RESOLVED that the Council of the Rural Municipality of South Cypress initiate a special services proposal, in accordance with sections 310 – 325 of the Municipal Act, for the imposition of a special services tax, not to exceed 1 mill, levied annually, on assessed property lying within the identified western portion of the Municipality, during the tax years 2011, 2012, 2013, 2014, in order to generate a tax levy totalling $60,000.00 in support of the Wawanesa Water Park project. “carried” RESOLVED that the Council of the Rural
Municipality of South Cypress acknowledge and accept notification from the City
of Brandon Fire Department that the enhanced 911 service fee for the year 2011
for the Municipality will be set at $2.99 per capita, which is an increase from
2010 of .09 cents per Municipal resident. “carried” RESOLVED
that the Assessments as listed below be added to the Rural Municipality of South
Cypress’ 2010 Assessment Roll under the Authority of Section 321(1) of the
Municipal Act; AND
FURTHER BE IT RESOLVED that the additional taxes thereon be added to their
respective property within the Rural Municipality of South Cypress, as added
taxes for year 2010 under the Authority of Section 321(1) of the Municipal Act.

RESOLVED that the Council of the Rural Municipality of South Cypress authorize Reeve Earl E. Malyon to attend the Assiniboine Regional Health Authority’s Annual General Meeting being held in Souris, Manitoba on Wednesday, October 20th, 2010. “carried”
RESOLVED that the Council of the Rural Municipality of South Cypress host a year end Appreciation Banquet for its Municipal Employees and its retiring Council Member(s) to be held on Saturday, December 18, 2010 @ 7:00 p.m. at the Spruce Woods Inn. “carried”
RESOLVED that the Council of the Rural Municipality of South Cypress do now adjourn @ 12:45 p.m., to convene again for its 2010/2011 Inaugural Meeting scheduled for Tuesday, November 9th, 2010 at 8:30 a.m. “carried”
